IMO, their best bet is to add kinapping (which is exactly what she did) - that will make it capital murder.

I just saw on CBS 11 that they have placed her under house arrest and raised her bond.
In my opinion she should be in jail right now but they do not consider her a flight risk.

I've noticed the crime ebb and flow over the last 10 years. For awhile things slowed down. A few of us were talking the other day and we all thought that it was starting to get bad again. Racial tensions seem to be getting worse.

Having said that, in my legal opinion, this isn't going to be prosecuted as a capital murder. You can argue that the victim was being kept against his will, and that amounted to a kidnapping, in order to qualify as capital murder, but it's not going to fly.
There certainly was no intent to kidnap this person at the time of the accident, and there's little doubt that she would have left him on the road if he hadn't stuck in her windshield. After she got home, she made no effort to prevent his escape, not that he could, of course. But it's pretty evident that she didn't want to kidnap the guy. She just didn't want to deal with the situation.
She deserves the maximum punishment under the murder statute, but bumping it up to capital murder is going to be a tough sell, and I don't think it will happen.

Oh wait, if she did that she wouldn't have been able to have sex while a white man was dying in her garage." Let's be fair, though. She probably figured he'd die sooner than he did. How can we hold her to blame for him taking too long to die?

I suppose it's possible that pulling down the pants was a half-hearted, dimwitted attempt to persuade the police that the guy died in some sort of sexual encounter gone wrong. Anybody know whether the park where they dumped the body is a homosexual trysting ground?
