Would death by torture count? Bleeding to death while imprisoned by broken glass for two days would appear to be sufficiently hideous to merit a death penalty.

What she did to the white man, and how he suffered was every bit as bad as the "hate crime" against Byrd in Jasper -- will it become as infamous?.

Ask yourself who Ken Tillery is. He’s the WHITE man who was dragged to death in Jasper Texas 6 weeks ago by 3 racist blacks. You remember, right?

Try doing a Google search on Jasper Texas Murder. You’ll get through 2 and ½ pages before you see any mention of this case.

Ask someone who Mark Furhman is and you’ll probably hear “Oh he’s that racist cop that tried to frame O.J.” Now ask them who Colin Ferguson is. Blank stare. (He killed 4 and wounded 19 on the Long Island Rail Road in December of 1993.)

Yeah, a double standard and hate crime legislation are a wonderful combination.

Why does the article state that "life in prison" is the maximum penalty even though the murder occured in Texas?

I used to live in Texas, and it is my understanding that the death penalty is only imposed for Capitol Murder, i.e. murder occuring during the commission of another crime, or murder of more than one person. I hope some Texan will correct me if I'm wrong, as I moved away in 1982. Some of the early articles implied that the prosecuter would also charge her with kidnapping, thereby opening her up to a Capitol Murder charge.

She didn't have to stop and render him aid as he was already in her car. All she had to do was drive him to the hospital. Oh wait, if she did that she wouldn't have been able to have sex while a white man was dying in her garage.

She lets this guy die in her garage,that's murder in my book,and these #^#$(@'s help her hide the body and they may be charged.

  I would suspect it'll depend on how much the DA thinks he needs witnesses. If he has to make the trade - let them off in order to get their testimony, I'd be willing to go along with it. As long as it succeeds in seeing that this woman never again sees daylight.

How about Kidnapping? She kept this guy captive in her garage for several days.

Remember the outcry when those guys dragged the Black fellow to death in Texas? This guy lived for several days begging that b-word for help.

Her lawyer says it is a simple case of failing to stop and render aid. All the assault with a deadly weapon, kidnapping, false imprisonment, and stuff like that don't count since she was drunk and stoned at the time. You know that meaning of 'is' is stuff sure spread fast.

It doesn't meet the definition of capital murder under the Texas Penal Code, and that's the only murder that may be punished by the death penalty.

How is it any different from James Byrd? She TORTURED that poor guy until he died.

The following crimes are Capital Murder in Texas:

murder of a public safety officer or firefighter;

murder during the commission of kidnapping, burglary, robbery, aggravated sexual assault, arson, or obstruction or retaliation;

murder for remuneration;

murder during prison escape;

murder of a correctional employee;

murder by a state prison inmate who is serving a life sentence for any of five offenses (murder, capital murder, aggravated kidnapping, aggravated sexual assault, or aggravated robbery);

multiple murders;

murder of an individual under six years of age.
