As a soldier, you either follow orders or choose to go to prison. This kid has chosen the latter. I just hope that he has the balls to plead guilty and then do his time.

That’s my point exactly. This kid knew what he was signing up for...there’s no clause in that contract that say you can get out of following orders as long as you dont “agree” with them. And all of a sudden this is news to him???
In the actual article he states that he is aware that he might go to prison,,,but he states it more as a sympathy plee rather than a point of fact...

Yes, perhaps this retard didn’t realize that he was signing up for an EIGHT YEAR ENLISTMENT, four years active four years ready reserve. It is hardly conscriptment to activate the ready reserve portion of the contract of a volunteer.
That being said, a soldier stows his political opinion under his bunk with his other gear and goes about his duty, IF he is really a soldier.

Actually there is. If you believe an order to be unlawful, then you are SUPPOSED to refuse it. Of course, you better be right.

well in this case his arguement is that the “occupation” is illegal and unconstitutional...I’m fairly certain the fact that this was declared by our President with approval from Congress makes it both legal and constitutional. Period.

Legal? Yes.
Constitional? Probably.
Necessary? No.
Basically this kid is bound for prison and he deserves it.

The way the IRR was explained to me was that not only could I be called up at any time, I could be called to report to a nearby military base to check my fitness for service. Heck, I even worried that I'd get called over to Fort Drum or Griffiss AFB (nearest bases) for such a check and show up with my weight way out of regs, because I gained about forty pounds right after I got out.
And that was back in '94, when we didn't have a war going on and my career field was over 100% manned according to Air Force requirements.
