Arizona Judge Rules 1864 Law Banning Nearly All Abortions Can Take Effect

TUCSON, Ariz. (CNS) — Arizona Attorney General Mark Brnovich praised Pima County Superior Court Judge Kellie Johnson for ruling Sept. 23 that a state law prohibiting nearly all abortions can take effect.

“We applaud the court for upholding the will of the Legislature and providing clarity and uniformity on this important issue,” Brnovich said in a tweet. “I have and will continue to protect the most vulnerable Arizonans.”

The Republican attorney general filed a motion in July asking the court to allow the law to take effect.

Enacted in 1864, before Arizona became a state, the law prohibits all abortions except to save the life of a pregnant woman.

The law had been blocked since 1973, the year the U.S. Supreme Court handed down its decision in Roe v. Wade legalizing abortion across the country. That year the Arizona Court of Appeals found the state ban to be unconstitutional and it was enjoined in superior court.

With its ruling June 24 of this year that overturned Roe, the U.S. Supreme Court returned the issue of abortion to the states.

In her decision, Johnson wrote: “The court finds that because the legal basis for the judgment entered in 1973 has now been overruled, it must vacate the judgment (blocking the 1864 law) in its entirety. … While there may be legal questions the parties seek to resolve regarding Arizona statutes on abortion, those questions are not for this court to decide here.”

Also the judge is like, hey, i dont make the law, but i know what laws go into effect when this was struck down.

I am afraid you are missing the point big time. There is only one reason the Judge would drop this bomb a month out from the election and it amounts to huge gift to the rats. Brnovich is drawing as much attention to it as he can because he wants Masters to lose. This might cost us both races so this is very bad. The Judge knows damn well he is influencing the election. Everything else goes out the window and abortion will dominate the campaign from now on.

Indeed. Abortion continues, but in some states, in some places, thousands of lives will be (and have already been) saved. And, even though there’s more work to be done, the lives saved are in and of themselves a huge victory.

No. Not really. Think about your logic. Was there a right time or wrong time to end Roe? Anytime was the right time. Same here. Why do we have to wait until after an election to stop killing babies in the womb?

Because if the rats take it all in AZ because of this many many more babies will die because of this Judge doing this a month out from the election. The rats will push through unrestricted abortions, so yes for the sake of those unborn the Judge should have waited until after the election. He has to know this so he did it intentionally.

Any state can now make its own law regarding this. The judge did the right thing. He followed the law. If AZ is so bad off that it’s going to vote in people who legalize abortion, that would happen regardless. Dems make elections about abortion every cycle. That’s because they have nothing to contribute to solving crime, improving the economy, lowering taxes, protecting CITIZENS, etc, etc. Most people realize this.

If one puts the election aside this is still good news on an otherwise death rate of the unborn would continue.

You cannot put the election aside, this was an October surprises perpetrated by this Judge. Preventing abortions for a few weeks to give the rats AZ will cause countless more babies to be killed. I don’t know anything about this Judge but he is either a fool or a rat soldier. Doing this a month from the election amounts to election tampering.
