Genesis 23

The Death of Sarah

23 Sarah lived to be a hundred and twenty-seven years old. 2 She died at Kiriath Arba (that is, Hebron) in the land of Canaan, and Abraham went to mourn for Sarah and to weep over her.

3 Then Abraham rose from beside his dead wife and spoke to the Hittites.[a] He said, 4 “I am a foreigner and stranger among you. Sell me some property for a burial site here so I can bury my dead.”

5 The Hittites replied to Abraham, 6 “Sir, listen to us. You are a mighty prince among us. Bury your dead in the choicest of our tombs. None of us will refuse you his tomb for burying your dead.”

7 Then Abraham rose and bowed down before the people of the land, the Hittites. 8 He said to them, “If you are willing to let me bury my dead, then listen to me and intercede with Ephron son of Zohar on my behalf 9 so he will sell me the cave of Machpelah, which belongs to him and is at the end of his field. Ask him to sell it to me for the full price as a burial site among you.”

10 Ephron the Hittite was sitting among his people and he replied to Abraham in the hearing of all the Hittites who had come to the gate of his city. 11 “No, my lord,” he said. “Listen to me; I give[b] you the field, and I give[c] you the cave that is in it. I give[d] it to you in the presence of my people. Bury your dead.”

12 Again Abraham bowed down before the people of the land 13 and he said to Ephron in their hearing, “Listen to me, if you will. I will pay the price of the field. Accept it from me so I can bury my dead there.”

14 Ephron answered Abraham, 15 “Listen to me, my lord; the land is worth four hundred shekels[e] of silver, but what is that between you and me? Bury your dead.”

16 Abraham agreed to Ephron’s terms and weighed out for him the price he had named in the hearing of the Hittites: four hundred shekels of silver, according to the weight current among the merchants.

17 So Ephron’s field in Machpelah near Mamre—both the field and the cave in it, and all the trees within the borders of the field—was deeded 18 to Abraham as his property in the presence of all the Hittites who had come to the gate of the city. 19 Afterward Abraham buried his wife Sarah in the cave in the field of Machpelah near Mamre (which is at Hebron) in the land of Canaan. 20 So the field and the cave in it were deeded to Abraham by the Hittites as a burial site.

I have actually been in Hebron at the Cave of Machpelia. That was 38 years ago, and due to the violence in the area, it is probably no longer a Tour Destination. The Tomb of The Partriarchs contains the bodies of Abraham and Sarah , Isaac and Rebecca, and Jacob and Leah. Atop the Cave stands a huge ediface made of Herodian Stonework that contains a Mosque and a modest little Jewish Synagogue. In order to enter the building, a person has to remove their shoes, climb a steep stone staircase to the Mosque, and then through the Mosque to the Synagogue, retrieving the shoes at the end and getting back on the bus to be whisked out of town before anybody "starts something". So, I didn't spend a lot of time there, and kind of kept my head down most of the time. Since both Judaism and Islam claim Abraham as their Progenitor, the two Faiths have been quarreling over the site for centuries.

This Chapter is pivotal in establishing Ownership of the Site. In any Real Estate Contract, there are certain conditions that need to be met:

1. Name of Seller
2. Name of Buyer
3. Description of the Property
4. Amount Paid.

In addition, the transaction needs to be recorded someplace permanant, like City Hall or The Registry of Deeds, so that future generations will know who owns the property.

This Chapter has all four elements, and is, in effect, the Resistration of the Deed to Abraham and his descendants.

The problem is that both Jews and Muslims claim Abraham as their Ancestor, the Jews through Isaac, and the Muslims through Ishmael. Ishmael, you will recall, was the son of the slave woman Hagar who was promised many descendants just like Isaac was. But neither Hagar nor Ishmael are buried in the Tomb.

Isaac had twin sons, both of whom are considered "Prophets" in the Islam. The twins were named Jacob and Esau. Jacob's name was changed by God to become "Israel", and Esau's many descendants went on to be other Middle Eastern People groups. And, while Islam reveres both twins, only Jacob (Israel) is buried in the Cave of Machpelia.

This Jewish association with the site is so ancient that it is surrounded by a fortress that is unmistakenly Herodian. The beveled stonework is the exact same as that of the Western Wall which was a retaining wall for The Second Temple, also built by Herod.

And so, there you have it.

1. Name of Seller(Ephron the Hittite)
2. Name of Buyer (Abraham)
3. Description of the Property(Cave with surrounding Field.)
4. Amount Paid (four hundred shekels of silver).

Not only that, but the transaction was duly witnessed and recorded in the Torah, and we can look it up any time we want to.

There are at least two more "official" Land Transactions in the Bible, and both of them contain the Four Elements and are recorded. Seems like all the quarreling could be easily solve just by looking things up.
