In Tingley v. Ferguson, (WD WA, Aug. 30, 2021), a Washington federal district court dismissed First Amendment challenges by a family therapist to a Washington state statute that prohibits licensed counselors in treating minors from engaging in "conversion therapy" aimed at changing sexual orientation or gender identity. The court held that performing conversion therapy is "conduct", not speech. According to the court, the law still allows therapists to discuss the option of conversion therapy by someone else-- including someone within the exception for practitioners operating under the auspices of religious organizations. The court also rejected plaintiff's religious free exercise argument, saying in part:
[T]he object of the Conversion Law is not to infringe upon or restrict practices because of their religious motivation.... Plaintiff is free to express and exercise his religious beliefs; he is merely prohibited from engaging in a specific type of conduct while acting as a counselor.
Fire and brimstone are not far away.
Who has standing to object? Certainly not the state.
Wait until the DEMONCRAT to Sane Human Being conversion Therapy case gets heard.
If someone wants therapy to rid himself or herself of being sexually attracted to farm animals, is that also prohibited?
So it’s OK for degenerates to lure gullible kids to the darkside but illegal for anyone to help them find their way back.
What a world!
So burning a flag is not conduct but free speech.
But seeking counseling for your desired sexual orientation (but only if gay to straight) is the opposite.
They can twist that liberal logic to hideously hilarious ends!
This decision will be reversed on appeal.
No second thoughts permitted! No freedom to choose for you!
Sick, sick, sick.
Should be easy to overturn, since even strippers have been allowed to strip under first amendment rulings.
There was a time not all that long ago when it was not a crime for a person to have sex with an animal. When the legislature proposed making it a crime, Democrat legislators were attacked by some of there constituents and the proposeds legislation was withdrawn.
Not sure if the law was eventually passed, however I do know there was a situation in which a man was kicked to death by a horse who apparently didn’t appreciate being sexually abused. That is a fact.
Banning conversion to a Washingtonian? I’m all for it.
Not by the 9th Circuit it won’t. It it gets reversed it will have to be the Supremes that do it.
