I doubt that the charges stick. As a pastor of that church he had every right to be there at any time with anyone he wanted. His church was not open to the public at that time so he had a reasonable expectation of privacy so this was not a lewd public act.

I was an altar boy with a good buddy at 6 & 7 am services for 3 years.
Nothing like this went on. I was never molested nor invited to a party like this. After services we’d go down to the paper where we’d eat donuts, drink coffee and read the teletype news - right as it typed out.
Later we’d break into the our Catholic School (just a vent into the gym) to get warm.
Never mentioned that in confession - tell him where the vent was? Am I going to hell?
