TMLC Senior Counsel Hopeful Justice Kennedy Will Side with Hobby Lobby and Religious Freedom

Thomas More Law Center Senior Trial Counsel, Erin Mersino, was in the U. S. Supreme Court gallery yesterday, as the Court heard the historic oral arguments regarding challenges to the HHS Mandate filed by Hobby Lobby and Conestoga Wood Specialties Corp.

Mersino observed, “There was a division amongst the Court. Justice Kagan was clearly advocating to uphold the Mandate, while Justices Scalia, Roberts, and Alito recognized how the Mandate violated the plaintiffs’ freedom of religion.”

Continued Mersino, “But based on comments of the various Justices, and particularly, Justice Kennedy, I am hopeful that religious freedom will prevail with the majority of the Court. The government argued that the Mandate was necessary but never supported why the Mandate was a necessity—this is because it is not. There are a number of alternatives available to the government which would not involve stripping people of their religious freedom.”

The can’t rule that religion is strictly personal when the word “Establishment” is there in black and white.

I'm not hopeful.

Kennedy is a regular Liberal stalwart on Social Issues, especially Abortion.

I expect a 5-4 ruling against Hobby Lobby.

I wouldn’t trust Kennedy as far I can throw him. he’s maybe the worst republican-appointee in history.

Brennan and Blackmun were both Republican appointees. As was Souter. You really think Kennedy is worse?

Kennedy voted against Obamacare, at least, while Roberts wrote the majority opinion in favor of it. And Kennedy was apparantly PISSED that Roberts flipped his vote at the last minute.

Kennedy wrote the Court’s opinion in Lawrence v. Texas, which invalidated criminal laws against homosexual sodomy. That has led the way for homosexual “marriage” and the sodomization of America. Hell yes, he’s the worst.

Abortion was one day will be overturned. Might not happen in our lifetime but people are starting to see the light on that decision.

Once the institution of marriage is destroyed this country is over for all intents and purposes. Treating degeneracy like it’s normal will mark the end of this country. We will go the way of ancient Rome and Sodom and Gomorrah.

Kennedy is not a sure vote for the pro abortion side.
Read his dissent in Stenberg v. Carhart where he lost 5-4 when the majority struck down the Nebraska ban on partial birth abortion.
Then after SDO was replaced by Alito he voted with the majority to uphold the federal ban on PBA.
His great sin was changing his mind in PP v. Casey and reluctantly upholding Roe.
So he is clearly torn.
