Muslim Deoband fatwa: It's illegal for women to work, support family

LUCKNOW: Darul Uloom Deoband, the self-appointed guardian for Indian Muslims, in a Talibanesque fatwa that reeked of tribal patriarchy, has decreed that it is "haram" and illegal according to the Sharia for a family to accept a woman's earnings. Clerics at the largest Sunni Muslim seminary after Cairo's Al-Azhar said the decree flowed from the fact that the Sharia prohibited proximity of men and women in the workplace

"It is unlawful (under the Sharia law) for Muslim women to work in the government or private sector where men and women work together and women have to talk with men frankly and without a veil," said the fatwa issued by a bench of three clerics. The decree was issued over the weekend, but became public late on Monday, seminary sources said.

At a time when there is a rising clamour for job quotas for Muslims in India and a yearning for progress in the community that sees itself as neglected, the fatwa, although unlikely to be heeded, is clearly detrimental.

Even the most conservative Islamic countries, which restrict activities of women, including preventing them from driving, do not bar women from working. At the peak of its power, the Taliban only barred women in professions like medicine from treating men and vice versa. But there was a never a blanket ban on working, although the mullahs made it amply clear that they would like to see the women confined to homes.

Just backward freaks who need to use their power to keep women hidden and living as slaves. They can stone them, allow their sons to beat them, make them sweat on hotter than hell days by wearing a full covering of cloth with little ugly holes in it for them to see and breath through, BUT THEY WILL NEVER WIN IN THE END BECAUSE THEIR RULES ARE CRUEL. NEW DELHI: Darul Uloom Deoband, India’s foremost Islamic seminary, on Wednesday denied asking Muslim women not to work along with men and said it only suggested that working women should dress “properly”.

“We had only given an opinion based on Sharia that women need to be properly covered in government and private offices,” said Maulana Adnan Munshi, spokesman for the seminary in Saharanpur in Uttar Pradesh.

He denied a media report that the seminary was opposed to men and women working together.

“No new fatwa was issued,” Maulana Munshi told IANS on telephone, adding that even the opinion on dress code was given when a Muslim woman desired to know if women could go to work without a ‘purdah’ or veil.

“That too is one-and-a-half months old,” he said.

But the media report claiming that the Deoband seminary had issued a “fatwa” against working women has led to sharp reactions from leaders and scholars from the Muslim community.

Maulana N.A. Farooqui, secretary of the Jamiat-Ulama-i-Hind, said the Deoband fiat “should be understood in the correct perspective”.

He said Islam does not prohibit women from taking up jobs or moving outside the house but it was obligatory for them to keep themselves “properly covered”.

Congress MP Rashid Alvi said every religion had its own rules but the law of the land must prevail ultimately.

“Whatever a preacher says, it is according to religion. But if there is a conflict between religion and constitution, then the law of the land will prevail,” Alvi told IANS.

Former MP Syed Shahabuddin said Muslim women in contemporary life were educated, had taken up jobs and, in some cases, were helping their husbands in running businesses. “It is not possible to follow such a fatwa.”


Misogynist Mullahs and their flurry of fatwas

Over the years, I have read considerable material by and about the madrassas and visited several dozens of them across India. Although charges about madrassas being involved in training terrorists are unfounded, the allegation that they teach obscurantist and ultra-reactionary beliefs in the garb of Islam can’t be dismissed. Nor can the assertion that such beliefs lead to extremism and even violence be ignored. Such beliefs constitute a major hurdle in Muslims’ progress and play a vital role in keeping Muslims shackled under the sway of a class of patriarchal and narrow-minded clerics.

Certain views widely-shared among the ulema regarding matters like women’s rights are simply unacceptable in any civilized society. Reformist Muslims might argue that these views represent a distortion of “true” Islam, that they are based largely on fake stories wrongly attributed to the Prophet or patriarchal inventions of the ‘fuqaha’ (specialists in Islamic jurisprudence) but the mullahs have a ready answer to shut them up. In accordance with a report that they attribute to the Prophet, it’s they (so they insist) who are the heirs of the Prophet (waris-e anbiya), and, hence, entitled to speak on Islam. The madrassas, they claim, are “fortresses of the faith”.

Hence, they pompously insist, they have the sole right to arbitrate on Islamic affairs. This, they do through their pronouncements and a stream of fatwas, which, although technically only opinions, are taken as gospel Islamic truth by their unthinking followers.

Probably the largest madrassa in the world, the Dar ul-Uloom at Deoband, styles itself as the ‘Umm ul-Madaris’ or the ‘Mother of Madrassas’, having birthed several thousand madrassas associated with the Deobandi school across the subcontinent.

After Deoband created a storm with a fatwa declaring it unlawful for Muslim women to work outside homes, I read the website of Darul-Ifta, the house of fatwas, in which a section is devoted to fatwa on women’s issues. A random search revealed some blood-curdling examples of Deobandi wisdom. These are reproduced verbatim: Asalamu-Alikum: Can Muslim women in India do govt or pvt jobs? Shall their salary be Halal, Haram or Prohibited? It’s unlawful for Muslim women to do job in government or private institutions where men and women work together and women have to talk with men frankly and without veil.

Mufti Saab, please guide me on the issue that why women have to cover the face? Kindly provide proofs. May Allah reward you in abandon. If a young lady comes in front of ‘ghair mahram’ with open face, there is fear of ‘fitnah’, hence it’s necessary for her to cover her face.

Can a man along with his ‘mahram’ travel with a ‘ghair mahram’? If yes, upto what distance? Can a women travel with a male servant (driver) who is a ‘ghair mahram’ in the city for educational reasons, etc? If yes, upto what distance?

She can travel within 78km observing hijab. She is not allowed to travel alone with non-mahram driver, even if within 78km. Then also it’s unlawful; since she will be in privacy with a non-mahram. Deoband’s mullahs have the temerity to insist that their peculiar version of Islam not just guarantees women’s rights but even stands for the best form of gender justice.

If imprisoning women in their homes, grudgingly permitting them to step out only under very severe conditions, compelling them to spend their lives manufacturing children, forcing them to be veiled from head to toe, muffling even their voices and reducing them to servile and repressed beings is Deobandi-style Islamic justice, is it any wonder that hardly any educated Muslim woman takes the Deobandi mullahs seriously?

Non-Muslims, in general, are forced to think that Islam stands for untamed patriarchy and increasing numbers of Muslims now consider mullahs as the major cause for their backwardness.

A whole new class of Muslim women believe that they need to study and interpret Islam from a feminist perspective, cleansing it of its deep-rooted patriarchal, indeed misogynist, tradition of mullah scholarship.

It’s vital for Muslims concerned about their faith and its image and also about their co-religionists and their ability to function in the modern world to take the mullahs by their horns and immerse themselves in the battle to promote more meaningful and humane understanding of Islam.

I remember seeing an article on begging women in Muslim countries because they weren’t allowed to work. However, they were allowed to beg.

So in certain areas there are a lot of older widows out on the streets begging.
