Unfortunately, the pro-religion case is based on the same rancid misreading of the Constitution as the anti-religion case. Liberals have perverted, "Congress shall make no law respecting an establishment of religion," into "Nobody can say or do anything, if it's even vaguely related to a religious or moral belief, that somebody else doesn't like." Conservatives should not jump on the bandwagon.
The courts are the problem, not the solution.

Why don't the Catholics and religious who are offended do some passive resistance? Hold sit in's in front of the dean's office, hold a march and pray? Why don't they just hold a sit in in front of the statue.
Why are they sitting on their hands. The left has used these techinques now get going!

No governmental organization has any place whatsoever in financing or supporting art work denigrating a particular religion, or religion in general.
If the courts are going to follow the incorporation doctrine and apply the first amendment to the states, then we would be fools to let them apply a "first amendment" that reads "nobody shall make any law respecting an establishment of religion, except that it's okay to use tax dollars to trash Catholicism".

1. The statue is ugly, and I fail to see how it could be considered as beautifying the campus, but well and . . .
2. I wonder what the judge would have ruled if instead of the statue, there was a mosque with a phallus adorning the top in place of the crescent.

Been spending a lot of time just out side of Wichita lately. There is a porn shop on every other block. Topeka isn't much better.
I left Chicago because of the moral sickness, and now Kansas is falling to the same disease. The Free and Independent Republic of Nebraska looks better all the time!

I think that's signalling acceptance of an interpretation that's totally different from the intent of the Amendment, and is also detrimental to religious exercise. There's no question that this is an outrage, but it should be fought out with the administration, the alumni (usually on the side of good taste, unless football is involved) or through the state legislature. Submitting every dispute to the Federal courts is a big mistake ... that's why they think they're God.
