Yes, it was struck down...by the Ninth Circuit Court of Appeals. A Ninth Circus opinion is like the weather...if you don't like it, wait a minute. The Ninth gets reversed so often that it sometimes gets called the Sixth by mistake.

Umm .. check the news - read and understand more than a 10 sec sound bite from CNN ... order was stayed immediately, never went into effect, and subsequently stayed indefinitely when the 9th agreed to hear the case en banc. As of this date nothng has been issued by any court directing any state official to cease or slow the preparations for the recall and in fact the county registars and the SecState office are proceeding full throttle.

The Dem machine has broken its own back by destroying the state. There's no way they can clean the slate before the 2006 election. Plus, all the shenanigans they pulled in this one will just get people angrier.

McClintock could be elected, clearly, in this environment, were it not for a fly-by-night candidate splitting the anti-Democrat vote. But the party machine backed Arnold, and gave conservatives a choice: our way (liberal socialism packaged in GOP clothing) or the highway.

Conservatives, intelligently, have rebuffed this thuggish power play, and reversed it. Our way (meeting acceptable minimum standards to conservatives) or the highway.

The resulting feud will demonstrate that the grassroots conservatives remain the heart of the GOP, not just in California, but in other state parties nationwide.

As long as McClintock is the only candidate that meets the minimum standard for acceptability, he's the only one that any conservative can in good conscience approve. Conservatives will NEVER back a liberal socialist, even a Republican liberal socialist.

I have. These so-called 'conservatives' claim that winning is not only the highest virtue, but the only one.

because it will break the back of the Dem political machine in california. He's not going to be governor for life, his election offers an opportunity for a victory, something to build on in an otherwise solidly Dem state. And considering the alternative is the election of a racist and corrupt Dem, why not take a chance?

Maybe true. But the right has not won the Republicans many state wide victories since Dukmejian.

If the GOP wants to win state wide and U.S. Senate seats in California, it seems that it will have to step to the left.

It's up the right to decide whether taking one step to the left is better than taking 2 steps to the left.

On top of that, he IS a socialist. Watch him pander to the race-hustlers by opposing prop 54, or to the soccer moms with school spending.

CA needs someone to do some union busting on the teachers' unions like Reagan did with the air traffic controllers, not pour yet more money down that sinkhole of corruption and waste.

The original 3 judge panel issued an order, null as it may now be, that never went into effect. They stayed their own order for 7 days. When en banc review was considered that order was stayed indefinitely, and when en banc review was granted it was effectively vacated. Anything other facts I got right that you care to argue about?

What you say in that post is absolutely true. I agree 100%. But there is zero chance any of that happening if CB wins.

If the right is AS's kingmaker, the right will have his ear when it comes to implementing reform.
