Thanks for the uplifting info about the chances of SCOTUS throwing this out... Congressman BillyBob, it was a relief to have your wisdom in this matter :-)

**"Today, I call upon the Secretary of State to immediately appeal this decision on behalf of the citizens who have exercised their constitutional right to recall Gray Davis, and who expect an election on Oct. 7.

"Historically, the courts have upheld the rights of voters, and I expect that the court will do so again in this case.

"I will continue to vigorously campaign for governor. The people have spoken, and their word should -- and will -- prevail."**

Sounds like leadership to me!!!!!!!

This is a win-win for the the dems. If the Supreme Court overturns it, they'll scream...

I hope they do. When the Dems are finally SCREAMING to support an order deeming all minorities are stupid and inferior and may not even be high enough primates to wield simple tools, maybe FINALLY THE WORLD WILL SEE that one party supports all people colorblindly to achieve their best, and the other panders and pities.

Someone on John and Ken just said that if the punch cards are not working/available at a precinct, it is fully acceptable to write your candidate's name in pencil instead.

If that is so, then at the very least we should be able to write in our candidates that way in October.

Or maybe the courts want to stop that too. Actually writing may be way too difficult for some people, maybe because they have been educated in our $10,000 a year CA school system. They may have a point there.

I think that Ted Costa can appeal this, with or without support from the State of California, since he is named in the suit.

Sooooo....any thoughts on how long it takes SCOTUS
to review/come through? Are we talking hours? Days?
And are the absentee voters going to claim 'disenfrachisement' in the meantime?

In one case, it came through via fax before the 9th Circle-Jerk of Nitwits adjourned.

I heard 24 hours to SUBMIT the appeal, and then 48 hours after that to get an answer.

My understanding is that 24 hours are needed to show just how idiotic the 9th Circle Jerk was, and SCOTUS will need 48 hours to stop laughing long enough to b!tch-slap them :o)

9th Circuit's Rulings Frequently Overturned
Washington Times ^ | 6/28/02 | Joyce Howard Price

The federal appeals court in San Francisco that found the Pledge of Allegiance unconstitutional Wednesday is known as an activist court whose decisions regularly are overturned by the U.S. Supreme Court, legal analysts said yesterday.

"The 9th Circuit Court of Appeals' liberal record ... and its reputation as the most overturned court in the country ... have almost grown to the status of an urban myth," said Steven Fitschen, president of the National Legal Foundation.

Mr. Fitschen noted that in 1996-97, the Supreme Court issued opinions in nearly 90 cases. "It reversed 27 of the 28 rulings it got from the 9th Circuit, and 17 times, the reversals were unanimous," he said.

The order was stayed for seven days by the 9th to allow further appeal.

Yes but it would look so much better if the Democrat AG of California did it instead.
