CHICAGO (CBS.MW) -- California bond yields showed little reaction Monday to a federal court ruling delaying the state's recall because of controversy surrounding punch-card ballots and the lengthy candidate list. Municipal-bond traders said that in general the market doesn't view the ballot issue as having a lasting impact on the recall. One trader said intermediate-maturity notes were trading at about a 40-basis-point spread over lower-risk Treasury debt, near levels seen before the court ruling was announced. One analyst said the market has been showing limited reaction to daily changes in the election outlook, as confidence among bondholders has grown for the recall's being voted down Oct. 7 or the election of Democrat Cruz Bustamante, the state's lieutenent governor. In either case, then, the muni market would be more upbeat that state budget progress would win out over political wrangling, the trader said.

Could the Secrtetary of State offer a remedy which would not "violate" equal protection, but still keep the election date of October 7? In order to make things equal for every voter in California, consider switching to hand-counted, paper ballots for everyone?

new democrat tactics for both sides of the political spectrum...
1. delay election till things are better for your team.
2. count till you win, recount as needed...
3. in the meanwhile ram through as many partisan laws and exec orders as you can, to try and maintain power.

See my post #333 on this thread for a table with the names of all active 9th court justices and who appointed them. The odds of getting a Clinton or Carter appointee to hear a case on that court are very high.

The ACLU signed off on requiring the punch card ballots to be replaced in time for the 2004 Presidential Election.

Now they want their agreement take effect before their agreed legal deadline because one of their hero's might lose power.

You're clearly right here: the California courts, including the liberal California Supremes, have tossed every challenge to this election. Unlike some of the states in the South, where the feds had jurisdiction over elections because of past de jure segregation and discrimination, California has not such history, and no such prior fedederal claim of jurisdiction.

The troubling precedent, however, in the back of my mind is Baker v Carr, in which states' bicameral legislatures on the model of the US - ie reps by population and senators by county -- bit the dust- Frankfurter's dissent pointed out, correctly IMHO, that in Colegrove (which Baker overturned) several justices were clear that there was no jurisdiction for the feds to intervene in the drawing of state districts, etc.

my considered opinion in THIS case is that SCOTUS will throw out this Ninth Circuit Order on an Emergency Basis. The Order to do so will be signed by Justice O'Connor

I hope you are right. I suspect that, if that does happen, she will start by issuing an emergency stay order in her capacity as Circuit Justice for this circuit, and refer the matter of granting-cert-or-not to her brethren ... although if O'Connor wants cert, it's a good bet that fellow Californians Kennedy and Rehnquist will go along. That's three outta four. No way would none of the other 6 join in. (That's IF the 9th Cir. ruling's already been stayed. I think there'd be a problem getting cert if there's no stay and the election's cancellation has "taken," such that a reversal wouldn't allow the election to be put back on for October.)

I think you are wrong. SCOTUS will hear this and probably by the end of the week. The difference in NJ was that the State Supreme Court had made a ruling according to State Law which was upheld by the feds. Here the State Surpreme Court has already stated that the election must go on and the Feds have overturned the State Courts. Thus it is now a federal issue. My guess is that it will be 9-0 to overturn this stupid 9th Circuit. The election will go on.

Sean Hannity just made a good point

Say this 9th Circus is correct .. then that would mean that Davis is not a legit elected Gov. since there are so many problems with this ballot system
