The NJ case was appealed from the State Supreme court directly to SCOTUS, not from a Federal Appeals Court. I do not know if this makes any difference, but it seems to me it should.

Here come the illegals - getting their motor-voter drivers license vote registations JANUARY 1st, 2004!!!

I'd say what was on my mind about what needs to be done about these damned activist judges, but doing so would get FR and me in hot water.

Time that we admited to ourselves we are no longer a republic, nor even a democracy, but rather a judiciocracy (to coin a term).
To: Peach
I agree with Rush on this. The SCOTUS don't want to get involved in elections again, especially state ones.

Why can't California borrow some election machines from another state that isn't using them during this period?
To: Tree of Liberty
SCOTUS does not have to assemble to rule on this. Judge Napolitano on Fox, right now, is saying that the Circuit Justice on this is Kennedy. I believe he's wrong on that.
He is also saying that the one Justice can only stay the lower court's order for a limited time "to let the whole Court decide whether to take the case." On this he is DEAD WRONG. I obtained exactly such an Order in September, 1976 compelling the State of Texas to put Eugene McCarthy on their ballot for President in 1976. That Order stood, and the Supreme Court NEVER did take that case.
I'll follow up with other comments as I read through these comments.

after January 1 the illegals will vote...aarg!

Federal Election Law is fairly clear on Presidential elections. Bush V. Gore was about a State Court trumping a Federal Election. This is different in that it is a Federal Court trumping a State Election and State Law.
It is iffy on how this might come out.

Good point. I don't think I understand the issues well enough to correct Rush.
But I like your thinking:-)

knowing this court, they will take the case, stay the order, let the election proceed, then uphold the Circuit Court decision next summer, leaving the election results intact but forever in question - did I nail their style or what?
To: Cinnamon Girl
I would NOT be surprised if the supreme court declined to hear this...They have declined many other important issues like the miguel estrada nomination...which could have put an end to this BS.
To: Sabertooth
The SCOTUS is scattered about on vacation.

I was able to vote with PUNCH CARDS without any difficulty.
That's because you're not a MORON. Morons, however, are the protected elite now in our country. After all, how can liberalism survive without them? Soon there will be a ruling that decrees that every MORON must be accompanied into the booth by a government "helper". Guess which party will benefit from that.
To: mwl1
there is a difference in this case from NJ...NJ was a state court...9th is a Federal...the USSC had BETTER be concerned about a Federal court...frankly, they should have no jurisdiction, it's a state matter. That might be their ticket out, they can void the 9th's ruling since it is a state matter. I know the 9th is involved since FEC gets involved, but that might be seen as weak in this case.

Apparently it will now be appealed to SCOTUS so this is NOT final by any means. And SCOTUS will spank the 9th circuit. :)
The recall will go forward.
