We failed Miguel Estrada and allowed Senate Democrats to erect a glass ceiling.

Not only is this a sad day for Miguel and Laurie Estrada, but we have all let something unfortunate occur in Washington. We allowed the U.S. Senate to erect a "glass ceiling" in our courts--you can do all the right things in America, but if you do not agree with Ted Kennedy and Hillary Clinton, you need not apply as a federal judge. This is the message that Democrats hope minorities, in particular, get from their victory as they succeeded in repelling a talented man, who happens to be Hispanic, from public service. For the hard left, Miguel Estrada was not qualified to be a federal judge because he would not march to their drumbeat.

Amazing article, and totally spot-on!

I wonder, however: will the apologia choir hereabouts now claim that Clarence Thomas' wife -- in stating, plainly, that the GOP leadership shares the blame for the criminally botched opportunity to get Estrada seated -- is also "disloyal," or "insufficiently Republican"...?

Just read the responses on WSJ to this article. For the most part the GOP is getting blasted for non-support.

I still don't understand why Bush did not just "recess appoint" him

I read on a thread yesterday that a recess appointment only lasted until January 2005.

It was also UNPAID.

If I am remembering this wrong someone please correct but if I am remembering correctly that a recess appointment is unpaid it would obviously not be in Mr. Estada's interest to accept.

That's correct, it's both temporary and unpaid.

this is indeed a sad day for america...except of course if your a democRAT and a spineless republican senator...... republicans in the congress should be ashamed of their conduct...but they arent as we all know... they will probably be out tonite with their RAT buddys!

I'm very impressed with the story of Mrs. Thomas.

Probably part of the reason that what she says is so impressive is that I'm reading "Hell to Pay." Hillary Clinton was appointed to every position she's had until the Senate. (And she sold herself for that one)

The Democrat Senates of the past have let her slide, but chew up and spit out good conservative men and women.

I think it was Schumer who said the other day that the President has not been sending "mainstream" candidates for the advice and consent of the Senate. He may have been right, if the "mainstream" he's talking about is the current judiciary.

He's wrong about the mainstream that is the American citizenship.

The Republicans in DC need to learn a lesson from what we've been through in Texas. The Dems will use any tool they can to lie, cheat and steal away the Republic. We need to stand tough. The new tradition of 'filibuster' is as ridiculous as our Senate's 2/3 tradition.

I have always thought Clarence Thomas was a very smart man. Now I'm positive.

The _new_ rule is: in the Senate, 67 votes are necessary to confirm a judicial appointment.

Actually I think it is 60. But the gist of your post is correct. In my opinion, the filibuster must be removed for judicial advise and consent. It solves the problem permanently.

I have grown so weary of Washington Republicans and their talent for snatching defeat from the jaws of victory.

I fought. I called and emailed representatives. But we can still do that - perhaps the people we need to be calling and emailing now are the dems - telling them just how much we recognize their desire to politicize the courts.

Wouldn't it be great to have Freeper groups around the country who followed their senators around with signs stating "You defeated Estrada" - following them to restaurants and the grocery store and the hardware store? Never letting them forget that they've politicized the judicial system.
