Cracking Down on Criminal Illegals

It should never have happened. This past December, a man and woman sitting on a New York City park bench were surrounded by a gang of young men. The gang kicked and beat the woman before dragging her along the nearby railroad tracks and forcing her into the woods, where they repeatedly raped the 42-year-old mother of two and threatened to kill her.

It was a vicious, tragic and horrific crime, and, again, it should have never happened.

It should have never happened because the five males charged with this heinous act were illegally living in the United States. Even more unbelievably, four of them had a criminal past and had been in the hands of law enforcement authorities, two having actually served jail time. But instead of being immediately deported, as the law insists, they were released back onto the streets.

This case is troubling enough alone, but when pieced together with the growing litany of tragic tales in big cities and small towns alike, it becomes clear that this criminal alien offense is more than just an isolated incident. Instead, this heartbreaking episode is reflective of a badly broken immigration law enforcement system that provides little or no coordination between federal, state and local officials; is badly outmanned; results in safe havens for common criminals who roam the countryside, instead of safe streets for the law-abiding citizens who call it home; and needlessly and increasingly endangers the very homeland security of the United States at a critical time in our nation's history.

In today's America, there are almost 400,000 individuals who have been ordered deported but are instead hiding out in our communities. Of these, roughly 80,000 are criminal aliens. That means there are 80,000 illegal aliens with criminal convictions on the prowl thanks to our broken immigration system. Think about that. They were in the hands of law enforcement at one point, but are walking the streets today when the law says they should have been deported.

Can you imagine if our government decided one day that we would invite 80,000 aliens to live here illegally, oh, and by the way, they're all going to be convicted criminals? It would be a catastrophic event and would be met with universal outrage. But because today's state of affairs has been allowed to happen over an extended period of time and gone largely unreported by the mainstream media, it seems somehow less shocking. The fact is, however, the result is exactly the same in either instance -- a failed system and a major crisis.

So what great force of manpower is our federal government devoting to this problem? A total of 2,000 agents. That's right. Just 2,000 federal agents have the job of enforcing our immigration laws.

It's high time we gave these outmanned folks some much needed help.

Last month, I introduced a bill that will take a giant step in that direction, the Clear Law Enforcement for criminal Alien Removal Act of 2003 (or CLEAR Act).

This is legislation that will finally give assistance and motivation to the 2,000 agents in the field; access to data, clarification of jurisdiction, and appropriate funding and training to local and state law officers who will now be able to help them; clarification and teeth to the laws already on the books; and order and accountability to a system that has lacked both for too long.

We shouldn't accept a system that allows criminal aliens to be turned loose, fall between the cracks, and commit crimes again and again, but we do. We shouldn't accept a system that discourages a local police officer from enforcing immigration laws, but we do.

The brutal attack and rape that took place last December in a New York City park should have never happened. If this legislation had been in place, it would have never been permitted to happen.

Uhhhh.....that's a redundancy. All Illegals are criminals, and they should all be deported (for good) immediately, whatever branch of government learns of their status.

18 POINT ACTION PLAN: Border Violators

1) Close all US borders to illegal entry forthwith by any and all means possible, including military presence.

2) Maintain legitimate immigration levels at modest annual level with requirements that immigrants be employable or sufficiently wealthy for self-support if they do not intend to work, proficient in basic English and willing to be assimilated into American culture and language. All applicants shall provide prints, photos and DNA samples.

3) Legal immigration shall be awarded to individuals on a lottery basis, wherein all countries are given equal status in the immigration lottery, without regards to color or economic plight of originating nation.

4) Individuals of Islamic faith (muslims) from any country shall be denied immigration privileges or entry into the US. Christians and Jews from muslim countries fleeing religious persecution shall receive accelerated immigration privileges.

5) Detain all border violators, taking photos, prints and DNA samples of said violator while at the same time, checking for out standing warrants. If no warrants are outstanding, return border violators to home country within 20 days via commercial airline and submit cost of such action, including processing and housing costs for said violator, to country of origin. If costs are not paid within 30 days, reduce any and all aid to said country by a like amount.

6) Should any country from which a border violator originates not currently receive any aid from the US, the Justice Department shall be authorized to seize or secure liens on assets owned, managed or registered to that country to the full extent of the obligation.

7) Establish new Guest Worker Visa (GWV) category, renewable every 6 months, for unskilled labor positions wherein all applicants shall provide prints, photos and DNA samples. Work permitted of such applicants shall be limited to one of several categories, including childcare, lawn/gardening, restaurant staff, cleaning and the like. Families of GWV workers are not permitted to enter US, nor will the birth of a child to one of GWV status confer citizenship to either parent or child.

8) Any violation of civil or criminal laws shall result in the forfeiture of the GWV and immediate return to originating country.

9) GWV holders shall be prohibited from claiming unemployment benefits, welfare support or free medical service.

10) The originating country of all GWV holders shall be responsible for any uninsured loss caused by the GWV, including emergency medical claims and/or claims resulting from illegal actions committed while in the US.

11) Companies who hire GWV holders shall submit to the Immigration Dept the name and GWV number of that individual, along with a description of employment tasks. Companies shall be subject to fines and penalty that fail to report employment of GWV workers, or hire border violators. GWV workers shall be paid with check, having income tax withheld. GWV workers shall not be subject to unemployment tax because they are not eligible to receive unemployment compensation.

12) Border violators, or any non-citizen not possessing a valid visa, detained by local police for any reason shall be turned over to border control officials for immediate deportation action, except if they face criminal charges in other jurisdictions.

13) GWV workers shall be prohibited for voting in local, state and federal elections.

14) Border Violators shall NOT be afforded the rights enjoyed by American citizens, as guaranteed under the constitution.

15) Public education (at institutions supported by taxpayer dollars) at any level (pre-school, kindergarten through the university level,) shall NOT be available to Border Violators (or children of Border Violators) and schools that enroll such individuals shall be subject to penalties.

16) Foreign Students (F/S) (individuals admitted to the U.S. for the purpose of attending any educational facility,) private institution or public (i.e. supported by taxpayer dollars,) must have valid student visas, such visas being in force only if the F/S attends school full-time. F/S shall be required to pay tuition, housing and related costs such that all their educational costs are fully reimbursed to the institution attended. The originating country shall pay for any and all loss caused by students while on U.S. soil.

17) Border Violators seeking emergency medical treatment shall provide pictures, fingerprints and DNA samples along with country of origin, and shall be treated, then incarcerated until information provided can be verified. Originating country shall bear the costs of medical treatment and confinement.

18) Children born in the U.S. to border violators, illegal aliens or of foreign nationals in the U.S. for any reason (including temporary visitor, school or work visas,) shall not be eligible for citizenship as circumstances of birth, nor shall the parents or parent’s family members (relatives) be conferred U.S. citizenship as a result of such births.

And some want to make the useless matricula consular a valid I.D. to make it easier for them to hide.

Man sentenced to prison for sexual abuse

A Lincoln City man was sentenced to prison recently after being convicted on a charge of sexual abuse. Cesar Rodriguez-Castillo, 26, was found guilty July 7 by a 12-member jury on a charge of Sexual Abuse I.

That jury found Rodriguez-Castillo not guilty on seven other counts of Sexual Abuse I, on two counts of Sexual Penetration with a Foreign Object II, and on one count of private indecency.
According to court records, Rodriguez-Castillo was convicted for sexually assaulting a female relative who was less than 14 years old during the time the abuse occurred.

When Rodriguez-Castillo was arrested by police in February on the sexual assault charges, he presented identification - a Social Security card and a resident alien card - that turned out to be forged. Rodriguez-Castillo later admitted to police that the documents had been faked and were obtained for work purposes.

In a separate case, Rodriguez-Castillo was convicted on two counts of Possession of a Forged Instrument I.

Rodriguez-Castillo appeared for sentencing on July 29 before Lincoln County Circuit Court Judge Charles Littlehales.

On the conviction for Sexual Assault I, he was sentenced to 75 months (six years three months) in prison, with 10 years of post-prison supervision. He will be given credit for time already served in the Lincoln County Jail.

Rodriguez-Castillo was also ordered to submit to a DNA blood draw and an HIV blood test, and he will be required to register as a sex offender after he is released from prison.

On the convictions for Possession of a Forged Instrument I, Rodriguez-Castillo was sentenced to 18 months probation. Rodriguez-Castillo's attorney was Paul Reim.

Instead of the Kolbe, Flake, and McPain bill, which would sell out the American worker to the lowest bidder, this is what Congress should be focusing all their attention on. Illegals have no business being in the US, period. And they should not be rewarded with amnesties and sham guestworker visas.

If the country for whatever reason needs more people, which is doubtful given the current amount of unemployed, we can simply raise legal immigration numbers. But illegal aliens must be given one choice: leave, or you'll be escorted out.

I have a much simpler solution, an idea based out of hollywood of all things, remember those things that went around their necks that blew up if they went past the border? Do something like that with all known illegal immigrants by broadcasting a nationwide rf frequency that if they so much as come within 50 miles of our borders that they have more important things to worry about, like getting the new and improved shampoo head and shoulders, although that would be rather pointless, now wouldnt it?

By law, being born in the US only gives one the right to declare US citizenship on turning 18. Parents of a baby born in the US do not get US citizenship as a result of that birth. Both CAN be deported to parents country of origin. It just is not done. However, as long as the child remains in the U.S., the child becomes eligible for a whole host of welfare programs and access to our education system.

As with many things in this country, new laws and rules are not needed to fix the problem--just enforcement of those already on the books.

THanks for your clarification. Regardless or whether you're right or wrong, the argument: "just enforce the existing laws" doesn't work because everybody goes 'ho-hum." We need a new document -- a hammer if you will to rally people to action.

Until there exists a will to enforce the law, all the new documents in the world are worthless. BTW, your argument is the same one the Gun-Control nuts use. Gotta be carefull with arguments that give politicians an excuse to pass more legislation. Sooner or later, they will bite you in the arse, even on issues that have your support. Remember Eisenhower's admonisment:

"A government big enough to give you everything you want, is big enough to take everything you have."
