The prosecutor in the Kobe Bryant rape case says he has slam-dunk evidence to prove the NBA superstar's guilt, it was revealed on the eve of the hoopster's first court appearance today. Eagle County District Attorney Mark Hurlbert made that strong claim in court papers arguing against making public the police affidavit written to justify Bryant's arrest early last month.

Just an observation, but don't you think he looks angry?

Yeah, he looks angry, but I don't think it means much. He could be angry whether he's guilty or innocent. I also don't think there was anything wrong with the way he dressed. His clothes were neat and clean, and that's all that really matters, at least to me. I'm sure he'll be wearing a necktie for the jury, though, for whatever that may be worth.

He said that he (Napolitano) would never require a defendant to attend a hearing like this.

That would be his prerogative, if he were the judge. It's been reported that Judge Gannon(?) has a reputation for always requiring a personal appearance at this hearings. If that is correct, then he would be showing inappropriate favoritism (or at least the appearance of favoritism) by making an exception for Bryant.

But he is concerned with face time. If he wasn't, he'd have closed the hearing. This hearing was a nothing.

I don't see that as a necessary conclusion. Someone posted Colorado's rules for cameras in the courtroom. Basically, if anyone asks to bring a camera in, the judge has to consider it, and decide whether it would dmage the "dignity and decorum" of the court (I forget the exact phrase). If he decides it would not, the cameras can come in.

If he doesn't regularly close these hearings, why close it now? Again, you guys are showing your bias by assuming that the judge just wants facetime. There's no way to know that. If you could get statistics that show how this judge regularly runs his courtroom and can show that he is deviating from his norm, then you may have something, but otherwise you guys are again accusing on no evidence.

I'll give you long odds it has never even come up before. Eagle County is a small community, and they probably don't have much serious crime, and even less where the defendant is a celeb. If that's correct, the judge may never have had to face this issue before, and wanted to see if the media would behave responsibly and follow the rules. So far as I could tell, they did.

I had the TV on FOX in my home office while I was doing paperwork tonight. I was surprised to Sean Hannity ask Rita Crosbby about the "ride home" story.
Rita is still standing by it - says she had five sources.

When will Johnny Cochrane show up and take over the defense? Will he bring a glove and a biased LA detective to screw up the prosecution again? Can he bring along the OJ jury? If so, Kobe walks.

If I were on the jury, I personally wouldn't consider it relevant, either. However, I can see how some defense attorneys could use it to convince at least one juror of reasonable doubt.

Actually, I do believe adultery is a criminal offense in Colorado.

After the recent SCOTUS decision on sodomy, how far do you think a prosecutor would get with an adultery charge?

I thought you talking of things like rape and murder. I don't think divorce and adultery are any more common in Nascar and Golf than in the general population. They might be but I haven't heard many stories about it. I know that where I work I hear a lot of stories about the people I work with so comparing that to Nascar and Golf I don't see any great difference in that. Tim Richmond got around too much and died from it but that was in the 80s and I don't think he was married.

By the way I don't watch golf and so I don't know much about the misdeeds of the players but I've heard some nasty stuff from morning radio shows about Norman so maybe I should cut it down to just Nascar.

The prosecutors in the OJ case proved their case beyond a reasonable doubt. OJ basically had jury nullification of the evidence.

This could cost me my membership in the white race, but I don't buy that. OJ was on an airplane 25 minutes after those murders supposedly took place and eyewitness accounts describe him as happy, talkative, and apparently lacking a care in the world.

Rangers and similar military professional killers I've spoken with tell me that's not possible, i.e. that nobody does his first grisly double murder with a knife starting at age 40 or beyond and then is seen happy and carefree a half hour later. They tell me that killing a human being with a knife is a very last option, and that even hardened killers can freak out from it.
