The prosecutor in the Kobe Bryant rape case says he has slam-dunk evidence to prove the NBA superstar's guilt, it was revealed on the eve of the hoopster's first court appearance today. Eagle County District Attorney Mark Hurlbert made that strong claim in court papers arguing against making public the police affidavit written to justify Bryant's arrest early last month.

Actually, I do believe adultery is a criminal offense in Colorado.

I am so sick of Kobe! Either he did it or he didn't, it's up to a jury to decide if ti comes to trial. Both he and his wife can go to h*ll for all I care.

I don't take anything as gospel that is reported. The only evidence that counts will be in the courtroom.Obviously the DA believes they have a provable case or they wouldn't prosecute but we shall see. That's why we have trials.

The sheriff said to me, Sheriff Joe Hoy, 'We have some dynamite stuff . . . this is not a he said, she said.'

I'm guessing that this dynamite stuff isn't going to be about the two 911 calls made from her house.

Why don't they release those? Calls from Kobe's house were available to the press.

Could it be more suicide attempts? That wouldn't be good for her credibility.

Then I don't think he should have used slam-dunk in his filings. That is uncalled for!

She isn't bringing the case against Kobe, the state is.The state can drop the case if she won't testify and they don't feel they can proceed, but they can prosecute anyway if they choose to.

An attitude is still one, regardless of where it is exhibited. What ever happened to professional decorum? Oh wait, I guess we're talkin' lawyers....my mistake.

Excuse me, but one report only says it's not true-notice the lawyers mentioned the Rita report-didn't say it was false. Nothing has been debunked. We will have to wait for a trial to know what media reports-if any-are true.

Or after expert testimony regarding the sizes of the genitalia of both the accused and accusor, the defense states that "If it don't fit, you must acquit."

That makes two of us -- Kobe comes on the TV and I switch channels which means I have been watching movies, etc., instead of cable news recently!

>>I don't remember, but this blustering attitude on the part of this DA can't be a good thing when one is going up against such power and money.<<

Unless he is telling the truth.

For example, it was "bite marks" that ended the long killing spree of Ted Bundy. If this DA says he has "dynamite," I think betting against him would be quite foolish.

I think the fact that the girl had emotional problems made the DA very cautious about going to trial. He had to have other evidence because any jury that hears a defendent is mentally ill is likely to discount her testimony. He reviewed the evidence in a very careful manner and then decided to charge Kobe.

Why do the FReeper threads on this subject seem to divide into mostly two distinct "cheerleader" sections, each cheering on either the defense or the prosecution, when *NO ONE* in this forum knows the truth about what happened?

It defies logic.

The problem is the DA has been on TV as well as every lawyer who wants face time that isn't even involved.

For that reason, I haven't followed the case -- let the facts speak for themselves. Calling something a slam dunk is a sure way to prejudice a jury and get it thrown out.

Dumb and dumber if you ask me. Just let the evidence stand and have the press quit trying to find every source they can so they can go on the TV with breaking news. It is prejudicing a jury with all this reporting hour after hour. BTW, I think he is probably guilty but in this Country there used to be some semblence of "innocent until proven guilty" but that seems to have flown out the window with cable news -- all of them!

Yes, the DEFENSE lawyers DO mention Rita, right after the paragraph that states:

Bryant's lawyers yesterday filed papers accusing the Eagle County Sheriff's Department and other law enforcement with violating a judge's July 24 order barring parties in the case from commenting on evidence outside of court.

And nobody ever reported the torn clothing and the drive home by the bellman except Rita -- and even SHE never reported it twice, nor has Fox News repeated it.

Tell me again how you're not anti-Kobe.
