The prosecutor in the Kobe Bryant rape case says he has slam-dunk evidence to prove the NBA superstar's guilt, it was revealed on the eve of the hoopster's first court appearance today. Eagle County District Attorney Mark Hurlbert made that strong claim in court papers arguing against making public the police affidavit written to justify Bryant's arrest early last month.

Also, I was surprised at the venom directed towards Jessica Lynch. She certainly didn't spread any stories. Why shouldn't she get a medal? She suffered horrific injuries (I think at the hands of the Iraqis-myself) and is now trying to heal. If you look at how badly she was injured, it is clear she will have pain for the rest of her life-and she is just a kid.

My local radio here in OK is claiming that the DA said those exact words for what it is worth! From the way I read the story, the DA made that claim in the court papers. It is my underline and my quotes in the referenced paragraph. Reread the snippet you posted. The words in quotation marks were "strong case". The words "slam dunk" were not in quotation marks. Doesn't that strike you as significant? It looks to me as if the only words in that snippet directly attributed to the DA are "strong case".

I enjoy good discussion of any issue.I don't see anything wrong with speculating about the outcome. Some see that as a want to skip the trial, I don't see how that connects. I think it's wrong to state things as facts when we're not sure what the facts are or when they come from anonymous sources.

I hope you are wrong. As you know, there is nothing wrong with your reasoning. There must be something to this purported physical evidence, or they wouldn't be leaking what they are. But, I won't believe it until I see it. This is the DA leaking, afterall. This story is not a "leak". It is an official release of information contained in court documents.
In the case of other news media reports, it is not clear who is leaking what. Remember the Starr investigation? The media report would make it sound like Starr was leaking grand jury testimony, only later it turned out that a lot of it was actually coming from the W.H., in order to discredit Starr by making him look like the leaker. Remember that Bryant's defense team has access to all the same information the prosecutor has; the leaks could be coming from them. The judge has just appointed a special investigator to look into the matter, so hopefully that will clear things up.
But regardless of who is leaking, that doesn't change the truth or falsity of the information being leaked. We will not be able to judge that until we see what is admitted at the trial.

I agree that there are lots who cry rape who weren't. I agree that bad things do happen because of women who cry wolf. I also know of women who just kept their mouths shut because of the kind of abuse given out to rape victims. I think what makes this case somewhat interesting ---it's not a stranger hiding in the bush type rape, it may involve a woman consenting to certain acts of sex but not all of them. Obviously her behavior is going to be part of the trial ---because it could get into her motives for accusing him. Since in the eyes of the law, he must be presumed innocent until proven guilty, the burden of proof is on the defense ---but it's not just her word alone that can convict him. Some of us might not agree with all definitions of rape others agree with.

Now that is interesting!! Whether or not Bryant is found guilty of rape, he certainly isn't innocent of adultery ---by his own admission and very likely isn't innocent of sodomy.

Even if the sodomy law was repealed, it seems it would still have to be an act that was consensual ---- new definitions for "rape" maybe --- she could have consented to oral and/or vaginal but he forced sodomy?

I must say, having an opinion (and I haven't said a word on what I thought of Bryant's appearance or demeanor today) about how he looked in attitude and apparel does NOT translate to determination of guilt.
I really don't understand why some cannot remark upon events without being falsely accused of violating the "innocent until proven guilty" concept.

I think a young soldier-injured in the service of her country-deserves our thanks. I think Jessica Lynch also deserves to be left off this thread because her case was completely different than this one ---- she was a war hero ----this is probably going to be kind of a disgusting he said--she said kind of case with more details than we really want to hear of ----except we'll for some reason all be paying close attention.
