The nation's largest circus will have to defend itself against charges that it mistreats elephants that perform under the big tent.
A federal judge has declined to dismiss a lawsuit by animal welfare groups claiming Ringling Bros. and Barnum & Bailey Circus has abused Asian elephants in violation of the Endangered Species Act.

I don't see where PETA is mentioned as one filing the suit. I think the interesting part is the "former Ringling Bros. elephant trainer". He should know. If the elephants are being abused, it should stopped.

If the elephants are being abused, it should stopped. Yeah, but it seems the case is hinged on their being endangered species - i.e. how OTHER elephants are doing.

First hit is he is the judge who ordered Cheney to turn over records on the energy policy.
Something about Manatees.
He dismissed the Wrestling Coaches lawsuit regarding Title IX.
"U.S. District Judge Emmet Sullivan fined CC $800,000 for not recalling "cloud cars" for rear seat belt systems deemed unsafe in a new standard. Chrysler responded that the reason for delaying the recall was because they were fighting it in court - and, when ordered to by Judge Sullivan, they did put the recall into effect (in March 1998)."
"A judge has ruled that former White House aide Linda Tripp, who played a key part in the Monica Lewinsky scandal, could sue former Clinton administration officials for alleged harassment. District Court Judge Emmet Sullivan rejected the government's request to dismiss Tripp's lawsuit. The judge dismissed a move by Tripp against the Office of the President - but allowed identical claims against the Department of Defence and former members of the Clinton administration to proceed.
