Man convicted of raping toddler gets 99 years

An Irving man convicted of raping a 3-year-old girl whose nude body was later pulled from the Trinity River after a highly publicized search was sentenced today to 99 years in prison.
Brett Bednarek, 27, was also charged with capital murder in the 1999 death of Cristy Ryno, but the recent trial dealt only with the sexual assault charge.
Calling Bednarek "a monster in our midst," prosecutors stressed during the trial that DNA evidence recovered from Cristy's body conclusively linked Bednarek to the crime.
Defense attorneys said DNA analysis is not foolproof and that evidence from the crime could have been mislabeled and mixed up.
They also presented testimony from friends who said Bednarek was with them during the time when Cristy was kidnapped and killed. Prosecutors argued that testimony was unreliable.
Bednarek, an acquaintance of the toddler's family, was arrested last summer -- three years after Cristy's death -- when one of his friends called police.
Prosecutors have said they plan to try Bednarek on the murder count, but that they will not seek the death penalty.
Cristy's disappearance from the Irving apartment she shared with her mother, twin sister and several adults prompted an Amber Alert and a massive search in the nearby wooded areas that lasted several days and captured widespread media attention in April 1999.

General population at Huntsville Correctional should take care of that quite appropriately.

Now please tell me why this is less bad than a so-called hate crime. Murder is murder. If any is worse than any other, it's the rape and murder of a child.

If I were the father of this little girl, they would have to imprison
me until the scumbag made it into his cell.
He'll get his reckoning in prison, I suppose -- he'll wish he had received the death penalty.

he probably will be placed in solitary confinement for his protection.unfortunately, vengeance will not be done.

accidents have been known to occur during transportation, where they are let off in the general population and all teh guards are sent looking elsewhere.
It would be a damn shame if some inmate were to misuse a sharpened toothbrush to violate and kill him.

they will not seek the death penalty It's worse for him that he should rot in jail - far worse. I know I'd rather be dead than go to jail. Death is easy - jail is hard.

Now that his guilt has been established, it'll be a slam-dunk for the capital murder for which he will get the death penalty.

DNA is not reliable enough to convict, but reliable enough to set prisoners free...HUH! Perhaps it's a process of exclusion.
Don't know much about the technical details, but look at it from the perspective of a fingerprint. If you can establish somehow that the print was from a particular finger (maybe that print on the glass was the only one not totally smudged), and that the only unsmudged small part of the print you have doesn't match -- it's clear evidence the print doesn't belong to the suspect.
OTOH, you'd have to match much, much more in order to say with any amount of certainty that the print belonged to the suspect.

Hopefully he will be thrown in with the general prison population and not kept in solitary for his own safety.
