Man convicted of raping toddler gets 99 years

An Irving man convicted of raping a 3-year-old girl whose nude body was later pulled from the Trinity River after a highly publicized search was sentenced today to 99 years in prison.

Brett Bednarek, 27, was also charged with capital murder in the 1999 death of Cristy Ryno, but the recent trial dealt only with the sexual assault charge.

Calling Bednarek "a monster in our midst," prosecutors stressed during the trial that DNA evidence recovered from Cristy's body conclusively linked Bednarek to the crime.

Defense attorneys said DNA analysis is not foolproof and that evidence from the crime could have been mislabeled and mixed up.

They also presented testimony from friends who said Bednarek was with them during the time when Cristy was kidnapped and killed. Prosecutors argued that testimony was unreliable.

Bednarek, an acquaintance of the toddler's family, was arrested last summer -- three years after Cristy's death -- when one of his friends called police.

Prosecutors have said they plan to try Bednarek on the murder count, but that they will not seek the death penalty.

Cristy's disappearance from the Irving apartment she shared with her mother, twin sister and several adults prompted an Amber Alert and a massive search in the nearby wooded areas that lasted several days and captured widespread media attention in April 1999.

They won't seek the death penalty, the DA bastards huh? My guess is he won't live long in prison. Even the most hardened criminal doesn't much like a guy who rapes a little baby.

OK, I'm confused, why in the world would they not seek the death penalty? Its not like Texas has a problem handing or carrying it out..........

Sick. I hope he suffers an "appropriate" punishment in prison before his is "off-ed" by his fellow prisoners.

Because it's cheaper to toss him in with the general population than pay for endless appeals.

This guy is headed to the Huntsville Correctional Facility. He will not last long and his stay is not going to be pleasant. The death penalty would be a reprieve from what he is going to see.

Having never been inside I can only rely on rumor, but from what I understand child rapists are not well received by other prisoners. Maybe he will do society a favor and take the Dahmer example.

DNA could have gotten switched, mixed up, blah, blah, blah....

Seems like we hear this with every crime now.

Why don't the investigators have a bullet-proof "chain of evidence" in all these cases? Video tape, sworn testimony, whatever it takes. From the time the evidence is collected there ought to be zero question about it's status - this shouldn't ever be an issue, IMHO.
