That and over zealous district attorneys are of great concern to some folks, especially those found guilty for crimes they didn't commit.

I have more trouble with the DA's than with the cops. I expect the cops to be the front-line troops who have to fight the war. I expect the DA's to exercise some judgement in what they prosecute and how they go about doing it. They know better. Supposed to.

But, like you say, that is not always how it works.

I'm with you on this. Is this a conservative poltical topic or just news for Modesto?

Will this story like Levy turn out to ruin a cheaters life and prove that the police are not very good at finding killers if they are not family or sexual partners? Will this turn out to be gossip?

Why would the police give out details of a wire tap? This looks like they don't have good evidence so they want this guy to look guilty.

Because monitoring attorney- client and investigator-client discussions is illegal, prosecutors wrote that they immediately stopped listening in most cases and did not learn anything "substantive."

In most cases? Hmmmm what did they hear in the cases that they didn't stop listening?

He said Peterson's defense team will review the documents this weekend and consider asking the Superior Court to throw out double-murder charges against Scott Peterson.>

Should this be considered the first time the defense asks for the charges be dropped? Be interesting to keep a tally.

Well, the police and the DA's office sometimes do land on someone. Usually they are right. They may have evidence, but it may not be enough. So they fabricate some more.

I'll give you fifty cents for every cop you can find who has never lied on the witness stand. I don't think I'll be paying you much. Maybe enough to get a cup of coffee at Starbucks.

It is the DA's office that is the problem. When they get locked into convicting someone, they won't let go even when they are clearly wrong.

not quite the police gave the info, by law they have to notify those whose conversations were intercepted, and notify them. In this case, Media lawyers want to know, and hear what is on the wiretaps, therefore the motions are before a court hearing, and pending that outcome, will be either admonished or admitted into evidence. I should say, also the lawyers who were also intercepted have that right too, and final for investigations if a law was broken on privileged or privacy rights..(that is my take on it)

When it comes to actually physically ransacking a guy's house, I want the cops restrained and careful, but when a wiretap is authorized, they should be able to collect all they can get and let the legal eagles sort it out afterwards. This doesn't apply to just this kind of domestic murder case. Wiretaps can and probably HAVE prevented major terrorist attacks...and on that level I don't want someone fiddling with the pause button when an attorney is on one end of the line.

There is a provision in the wiretapping laws that allows the investigator to ascertain from intercepted calls if the parties are planning or conspiring to plan illegal activities. That pertains to attorney calls with limitations. While LE cannot monitor for the entire duration, they are allowed to make spot monitoring of the attorney/client phone calls. At a judge's request, the MPD quit doing any spot monitoring after two phone calls of 69 to/from McAllister and SP.

The procedure that they used to avoid violating SP's rights is detailed in length HERE Warning it's a 31 page pdf. file. So if one is inclined to believe the sketchy press reports and McAllister's hot air then one should, also, take the time to read what MPD says actually happened with those calls.

"Dan Abrams was on the Today Show this morning and he said the defense is going to go after the character of Amber now."

Interesting tactic. But I would think VERY hard to do without further impugning Scott's character.

Why would they do that if she doesn't know something very damning? Other than that he was having an affair--which he has admitted.

well, all I can say is during the Clinton era, Janet Wacko Reno, was given multi agency task force to enforce or apprehend crimes. Meaning, maybe not Modesto had initial thoughts to use wire taps, but remember, the FBI was in this case from Dec 27th search warrants, so I suspose, since my crime readings, they are good at this. But, I tell you something, none of this would of occurred, if 1)scott didnt' kill his wife and child, and 2)scott's behavior and refusal to cooperate lead investigators to the roles they played out. Then this story would of stay low keyed until either Laci was found alive, an other suspect found, or Laci came back after having Conner. None of which occurred except Laci and Conner did come back, against their wishes, dead. Which is why the media is so involved in this crime saga caper... Scott caused it, and the media disected him.

I don't think any sane human being would enjoy media spouting every thing you ever did in your lifetime.... Scary!! ;o)

Who goes fishing in SFB in December? Ain't nothing there. Sturgeon possibly, but you have to go way up the east end to get them. The fishing trip story won't hold water.

I can't figure out HALF of the motives for what the defense is doing.

And if, as has been reported, they have tapes of telephone conversations between Scott and Amber, I cannot understand how attacking her character will somehow negate the impact of those tapes. I would like to hear the source of Dan Abrham's contention that this is yet another tactic the defense will employ.

I can't see the advantage. But I will be the first to admit, my "imagination" may not be as creative as the defense teams---specifically MG's.

If I was wiretapping someone's phone, I don't know if it would always be clear up front that attorney-client privilege applied on a conversation...and just because you stop recording doesn't mean you stop listening.

What plausible circumstances could there be where a call placed by the defendant to his attorney's office number, or from the attorney's office to the client, would be of legitimate interest to the police, but not be privileged? And how hard can it be, through the use of Caller I.D., for the police to identify these calls before anyone even picks up the receiver?

Let's not forget "THE Mystery Woman".

Gera-gross has told us he has found this woman who will clear Scott.

So, do we all fake amnesia? Or should we hold Mark's feet to the fire and demand he put up or shut up?

PS. Don't count on Geraldo, (aka, "Mr. Faithful" who's been married 6 times, and can't keep his pants zipped and is a self proclaimed womanizer)..for unbiased investigative reporting concerning the Mystery Woman. Heck, he probably suggested the alibi to Gera-gross, LOL.

"I guess it was too much to hope for the FR to be a Scott Peterson free-zone."

There's no reason it should be. It is news. If you don't want to read about it, then DON'T click on the topic. Otherwise keep you cold hearted comments to yourself or accept to be ridiculed for your insensitivity.

I want the news on this tragedy. Laci Peterson needs to be vindicated. I'd like to have some of my faith in the justice system restored and have the murderer of this beautuful, young woman and her innocent baby given the death penalty.
