Feinstein-Schumer Gun-Control Act
The Federalist ^
Posted on 05/17/2003 8:08:32 AM PDT by Tumbleweed_Connection
PatriotPetitions. US has launched a national campaign entreating our President, House of Representatives and Senate to reject legislation renewing the 1994 Clinton-Feinstein-Schumer Gun-Control Act. Please read this brief description of the campaign and let your voice be heard on this matter. Though House Majority Leader Tom DeLay says "The votes in the House are not there" to renew the measure, Feinstein and Schumer just introduced a bill in the Senate to renew the law, and they will press the House for a roll call vote in the upcoming election year. Unfortunately, President Bush has reiterated that he SUPPORTS the gun-ban -- an affront to the Constitutional right of all law abiding citizens to own semi-automatic sporting rifles for lawful purposes. Feinstein and Schumer even applauded President Bush, saying: "We welcome your support and look forward to working with you to gain swift passage of this legislation. With your assistance, we will be able to pass legislation to continue the ban and help make America's streets safer."
"Safer"? For whom? Such laws claim, ostensibly, to protect law-abiding citizens. Of course, only law-abiding citizens comply with these restrictions -- and at their own peril. Criminals don't care if the weapon they are using comport with the 23,000 federal, state and local gun restrictions already on the books. The Democrat's "incremental encroachment" on the Second Amendment is a thinly-veiled strategy to achieve their ultimate goal of gun confiscation, as Ms. Feinstein made clear after passage of her 1994 legislation: "If I could have gotten 51 votes in the Senate...for an outright ban, picking up every one of them, Mr. and Mrs. America, turn them all in, I would have done it!"
Please join fellow Patriots on the frontlines in defense of our Constitutional liberties.

Most Sweeping Gun Ban Ever Hits Congress:
Clinton Ban "Re-enactment" Targets Millions More Guns!!!
As we predicted, the anti-gunners have begun the push to further expand the Clinton gun ban of 1994. Not content with merely re-authorizing the ban, Reps. John Conyers (D-Mich.) and Carolyn McCarthy (D-N.Y.) have drafted legislation that bans millions more guns! It's a giant step closer to the goal stated by Clinton ban sponsor Sen. Dianne Feinstein (D-Calif.), who said on CBS's 60 Minutes: "If I could have gotten 51 votes in the Senate of the United States for an outright ban, picking up every one of them, Mr. and Mrs. America, turn them all in, I would have done it." Toward that goal, Conyers/McCarthy would:
* Ban every gun made to lawfully comply with the Clinton ban. The Clinton ban arbitrarily dictated the kinds of grips, stocks and attachments that new guns could have. Manufacturers complied. New guns were made to conform to the Clinton restrictions. Now prohibitionists want to ban the new guns, too.
* Ban guns the Clinton legislation expressly exempted from prohibition. This includes Ruger Mini-14s, Ranch Rifles, and .30 Caliber Carbines, and entire classes of guns, including fixed magazine rifles, as well as shotguns that hold under five rounds.
* Ban guns widely used for target shooting. It bans the three center-fire rifles most commonly used for marksmanship competitions: the Colt AR-15, the Springfield M1A, and the M1 "Garand."
* Ban all semi-automatic shotguns: Remingtons, Winchesters, Benellis, Berettas, etc., widely used for hunting, trap, skeet, and sporting clays, by banning their receivers (main component).
* Ban guns for defense. Bans any semi-automatic rifle or shotgun any U.S. Attorney General one day claims is not "sporting," even though self-defense is a fundamental right and the federal constitution, the constitutions of 44 states, and the laws of all 50 states recognize the right to use guns for defense.
* Ban 68 named guns (Clinton ban named 19 guns); Ban parts used to repair or refurbish guns, including frames or receivers; Ban importation of ammunition magazines exempt under Clinton ban; Ban private sales of millions of guns, their frames and receivers, and their parts; Ban semi-automatic rifles under 30" long (useful for home defense); Ban all semi-automatic rifles that can hold more than 10 rounds.
* Ban guns rarely used in crime. State and local law enforcement agency reports have always shown that guns on the Clinton and Conyers/McCarthy ban lists have never been used in more than a small percentage of violent crime. The Congressionally-mandated study of the Clinton law concluded that guns it banned "were never used in more than a fraction of all gun murders." But even if they were, are the rights and liberties of law-abiding citizens to be dictated by the acts of criminals?
* Begin "backdoor" registration. Requires manufacturers of banned guns, frames, receivers, and parts to report the names of their dealers, and requires dealers to report any of those parts they have in stock. The next step is obvious-demanding the names of gun owners who buy those parts.
Please contact your U.S. Representative at (202) 224-3121 or by using the "Write Your Representatives" feature and urge them to oppose any attempt to keep alive the Clinton gun ban.

How many "issues" can you name which are categorically denied by the general public yet ignored by Congress (abortion, taxes...)? Bush has introduced a new perspective to many who would have otherwise rejected our policy outright. One must ask what the hell is occurring today when, in light of 9/11, the leftists are more concerned with SUVs, freedom of speech, and our Second Amendment rights than terrorism?
To: joesnuffy
I don't really have the money for it, but if this ban goes into effect, the first thing I'm doing is buying an M1A.
I would say AR-15, but I live in a communist state that already banned it and every single similar rifle (i.e. no bushmaster, no Olympic, etc.)
For anyone who isn't familiar with what they want to do to you, let me give you a taste out of the California Code:
CHAPTER. 2.3. ROBERTI-ROOS ASSAULT WEAPONS CONTROL ACT OF 1989
ARTICLE 1. GENERAL PROVISIONS
12275. This chapter shall be known as the Roberti-Roos Assault Weapons Control Act of 1989.
12275.5. The Legislature hereby finds and declares that the proliferation and use of assault weapons poses a threat to the health, safety, and security of all citizens of this state. The Legislature has restricted the assault weapons specified in Section 12276 based upon finding that each firearm has such a high rate of fire and capacity for firepower that its function as a legitimate sports or recreational firearm is substantially outweighed by the danger that it can be used to kill and injure human beings. It is the intent of the Legislature in enacting this chapter to place restrictions on the use of assault weapons and to establish a registration and permit procedure for their lawful sale and possession. It is not, however, the intent of the Legislature by this chapter to place restrictions on the use of those weapons which are primarily designed and intended for hunting, target practice, or other legitimate sports or recreational activities.
12276. As used in this chapter, "assault weapon" shall mean the following designated semiautomatic firearms:
(a) All of the following specified rifles:
(1) All AK series including, but not limited to, the models identified as follows:
(A) Made in China AK, AKM, AKS, AK47, AK47S, 56, 56S, 84S, and 86S.
(B) Norinco 56, 56S, 84S, and 86S.
(C) Poly Technologies AKS and AK47.
(D) MAADI AK47 and ARM.
(2) UZI and Galil.
(3) Beretta AR-70.
(4) CETME Sporter.
(5) Colt AR-15 series.
(6) Daewoo K-1, K-2, Max 1, Max 2, AR 100, and AR110 C.
(7) Fabrique Nationale FAL, LAR, FNC, 308 Match, and Sporter.
(8) MAS 223.
(9) HK-91, HK-93, HK-94, and HK-PSG-1
(10) The following MAC types:
(A) RPB Industries Inc. sM10 and sM11.
(B) SWD Incorporated M11.
(11) SKS with detachable magazine.
(12) SIG AMT, PE-57, SG 550, and SG 551.
(13) Springfield Armory BM59 and SAR-48.
(14) Sterling MK-6.
(15) Steyer AUG.
(16) Valmet M62S, M71S, and M78S.
(17) Armalite AR-180.
(18) Bushmaster Assault Rifle.
(19) Calico M-900.
(20) J&R ENG M-68.
(21) Weaver Arms Nighthawk.
(b) All of the following specified pistols:
(1) UZI.
(2) Encom MP-9 and MP-45.
(3) The following MAC types:
(A) RPB Industries Inc. sM10 and sM11.
(B) SWD Incorporated M-11.
(C) Advance Armament Inc. M-11.
(D) Military Armament Corp. Ingram M-11.
(4) Intratec TEC-9.
(5) Sites Spectre.
(6) Sterling MK-7.
(7) Calico M-950.
(8) Bushmaster Pistol.
(c) All of the following specified shotguns:
(1) Franchi SPAS 12 and LAW 12.
(2) Striker 12.
(3) The Streetsweeper type S/S Inc. SS/12.
(d) Any firearm declared by the court pursuant to Section 12276.5 to be an assault weapon that is specified as an assault weapon in a list promulgated pursuant to Section 12276.5.
(e) The term "series" includes all other models that are only variations, with minor differences, of those models listed in subdivision (a), regardless of the manufacturer.
(f) This section is declaratory of existing law, as amended, and a clarification of the law and the Legislature's intent which bans the weapons enumerated in this section, the weapons included in the list promulgated by the Attorney General pursuant to Section 12276.5, and any other models which are only variations of those weapons with minor differences, regardless of the manufacturer. The Legislature has defined assault weapons as the types, series, and models listed in this section because it was the most effective way to identify and restrict a specific class of semiautomatic weapons.
12276.1. (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
(1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
(A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
(B) A thumbhole stock.
(C) A folding or telescoping stock.
(D) A grenade launcher or flare launcher.
(E) A flash suppressor.
(F) A forward pistol grip.
(2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
(3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.
(4) A semiautomatic pistol that has the capacity to accept a detachable magazine and any one of the following:
(A) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
(B) A second handgrip.
(C) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning his or her hand, except a slide that encloses the barrel.
(D) The capacity to accept a detachable magazine at some location outside of the pistol grip.
(5) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.
(6) A semiautomatic shotgun that has both of the following:
(A) A folding or telescoping stock.
(B) A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.
(7) A semiautomatic shotgun that has the ability to accept a detachable magazine.
(8) Any shotgun with a revolving cylinder.
Ugly, isn't it?
Oh, I almost forgot- you cannot sell or transfer pre-ban items, even to your own family members or in wills. Also, if you bring a pre-ban weapon out of the state, you are not allowed to bring it back in.

ANY "gun control" bill has about the same chance to be passed in the forseeable future as i do flying W/O wings, i.e. NONE!
the GOP-controlled HOR will NOT even bring it to a floor vote. (even RED NANCY pelosi admits that there is "no chance for new gun control bills to reach the house floor in 2004.")
the bill, upon arrival, will be sent to a sub-committee, from which it will NEVER be released. the GOP fears the wrath of gunowners/NRA/JPFO/GOA/etc.;so do the western & southern DIMocRATS (they have NOT forgotten who/what issue helped beat albore.).

This new bill makes it clear, there are NO type of guns that are to be spared this time around, they are after ALL of them. They do not care if you are a hunter or skeet shooter, they are out to take your guns.
Is'nt it true that that B**** Swinestein has to run for election next year?
Kali is a Babel of a state, so fractionalized that Gun Owners may be the most potent political force to be found in the next election, if they would just pull together as a group crossing party lines.
ALL Kali Gun owners need to work together this one time, with the goal of ensuring that Swinestein becomes the EX-senator from Kali.!
Perhaps shutting THAT high profile P.O.S. out of office would finally get candidates attention sufficiently to put a permanent halt to the continued attacks on our RKBA?

Most interesting that clause.
"The Legislature hereby finds and declares that the proliferation and use of assault weapons poses a threat to the health, safety, and security of all citizens of this state. "++
Weapons pose the threat.
" The Legislature has restricted the assault weapons specified in Section 12276 based upon finding that each firearm has such a high rate of fire and capacity for firepower that its function as a legitimate sports or recreational firearm is substantially outweighed by the danger that it can be used to kill and injure human beings. "
Weapon can be used to kill human beings.
" It is the intent of the Legislature in enacting this chapter to place restrictions on the use of assault weapons and to establish a registration and permit procedure for their lawful sale and possession. It is not, however, the intent of the Legislature by this chapter to place restrictions on the use of those weapons which are primarily designed and intended for hunting, target practice, or other legitimate sports or recreational activities. "
Weapons have to be used ONLY for hunting, recreational(?) and sport activity.
Nothing about self defense. So weapon cann't be used for that. Lean on police only.

Actually, this is a good thing.
What the democRATs refuse to accept is that their attempts at gun control cost them votes. Recent history is clear. DemocRATS have lost seats in every election where they made gun control an issue.
Sometimes the best way to destroy your enemy is to let them destroy themselves. Let them propose. We will refute and prosper.

Start saving your pennies to defeat these two.
I will finally think we're winning when Boxer, Feinstein, Schumer and Kennedy are collecting their retirement.

OR a M-1 garand, which over a 100 rounds shoots faster, as it's quicker to reload, has better range & is available for FAR less $$$$$$$.
also 3006 is AVAILABLE, even at 7-11 stores; 7.62 nato/.308 winchester isn't nearly as common in small towns.
my pet Danish SA/SG garand grades as "un-fired/un-issued" & cost me 400 clams (FROM cmp!) & a lot of elbow grease on the stock.
