Bar owners group to sue state over new anti-smoking law

Bar and tavern owners will sue the state to overturn the no-smoking laws that take effect on July 24, said Scott Wexler, executive director of the Empire State Restaurant and Tavern Association.

He's waiting for official notification from his board to initiate a lawsuit, Wexler said. Once that happens, he anticipates that it will take 45 to 60 days to put the suit together, he said.

On March 26 the state Senate and Assembly approved legislation banning smoking in bars and restaurants. Gov. George Pataki signed the bill into law later that day.

All of the Albany, N.Y.-area's Democratic legislators supported the measure, as did the area's Republican state Senators. The region's Assembly Republicans voted against the bill.

Should I be surprised how many posters on this thread do not believe in a free market system or in property rights?

No....ignorance and years of liberal brainwashing runs deeper than we thought...don't be surprised. Not to mention the fact that a certain percentage of the population is assinine to begin with.

As I have said before, if big tobacco can be bled dry for misleading the public, how about the politicians, they are more misleading than anyone else on earth......... time to bleed them dry.

That's a good point no doubt......maybe just "healthier" (from my statement) would make more sense....."cleaner environment" will never happen.......referring to me as naive is out of context so I'm not offended.

Give me a break - Cigarettes are actually good for the environment because what is Tobacco? A Plant and what do all plants do? Remove Carbon Dioxide from the air and when a cigarette is smoked not all of it is released as CO2 so every cigarette smoked results in a net lose in atmospheric CO2. So smokers should be praised for doing their part in fighting global warming.

Healthier Nation huh? Yeah they tried that back in Germany in the late 30's and early 40's. Look how good that turned out.

I hope the bar owners win. I don't smoke, hate the smell of it. But I hate government meddling and nannying in private business and property ten thousand times more. So, you go bar owners!!!

Hitler was a great enemy of smoking! For the "healthier nation" of course. He was a vegetarian as well, and meat will be next.

Wrong, NYS has passed a law superceding NYC, Smoking just about anywhere will be illegal July 24th. No restaurants, no bars, not even in a company car.

Then why stop there? Let's outlaw Mcdonalds, BK, Scissors, SUV's, Electricity, etc..
