Bar owners group to sue state over new anti-smoking law

Bar and tavern owners will sue the state to overturn the no-smoking laws that take effect on July 24, said Scott Wexler, executive director of the Empire State Restaurant and Tavern Association.

He's waiting for official notification from his board to initiate a lawsuit, Wexler said. Once that happens, he anticipates that it will take 45 to 60 days to put the suit together, he said.

On March 26 the state Senate and Assembly approved legislation banning smoking in bars and restaurants. Gov. George Pataki signed the bill into law later that day.

All of the Albany, N.Y.-area's Democratic legislators supported the measure, as did the area's Republican state Senators. The region's Assembly Republicans voted against the bill.

I doubt if the bar owners will win as long as the junk science about the dangers of second hand smoke still stands.

The tobacco companies caved in and they had the money to fight this nonsense so who else will do it?

If you don't like cigarette smoke, don't go to bars and eat joints that allow smoking.

If you do not like what others are doing, go else where. Why pass laws because you are a puss?

Agreed. I have a friend who owns a bar in Florida and guess what; he does not force non-smokers in there at gunpoint.

We should, as should the business owners, have the right to do so (smoke and/or be in a smoke-filled environment) if we so wish.

Funny how this point has been ignored by the "nanny-state" types. Where does it stop, I keep asking? Apparently there's nothing worse than being ignorant AND hard-headed.

Don't want to breathe second-hand smoke - then stay out of establishments where smoking is OK. This isn't rocket science, last time I checked.

The reasoning for this law was that workers at these establisments have no choice but inhale the SHS, well, why didn't they just make it mandatory that every establishment furnish gas masks or chem suits for the employees who wish to wear them?

That would have taken care of the issue.

The issue is not whether you enjoy a smoke filled or smoke free room. You have the freedom to go to a smoking or non-smoking establishment.

If the guvmint wants smoke-free bars and restaurants, why don't they give a tax break or a discount on the liquor license fees for establishments that want to be smoke free. Then the non-smoking public can have their places and the smokers can have theirs.

I plan to open a theme restaurant (using my own capital, on my own property.) We will serve beans and other gas-causing food, and celebrate all the ensuing farting, which will be supplemented with images, sounds and smells in accordance with the theme. The restrooms will have microphones to broadcast the special effects, and the stalls will have picture wondows overlooking the dining room. Disgusted?
