Why do so many people on this board have trouble believing that sometimes innocent people confess to crimes they didn't commit. They are usually weak and manipulated by the police prosecutors and defense attorneys.

Thirty years ago, my father represented a teenager who was accused of strangling his girlfriend. The kid confessed to it while in police custody -- no lawyer present, no parent present.

Anyway, to make a long story short, the kid didn't kill the girlfriend. A serial killer (an heir to the IBM fortune) killed her as well as several other girls in the area.

Innocent people do confess to crimes, especially when they are coerced into doing so.

Oh my goodness. Of course, SOMETIMES SOME people confess to crimes that they didn't commit. Ya think this guy's girlfriend had any sway over her daughter's recanted testimony!?!?

We don't let the exceptions make the rule.

Most of the time for most of the people, when they admit to a crime, they did it!

I have no idea whether or not the girlfriend had any influence over her daughter's testimony.

That's up to the prosecutors to find out if they want to retry him, I guess.

Yes. I posted an article on this. The story was he was coerced, the girl had told her friend she had accused him of this to get him out of the house and when she found out he actually went to prison for it, she admitted to police what the truth was. I'm pretty sure I got that right. I wonder, though, what is driving the prosecutors to put him back? Maybe there's something not coming out about this story?...

Rape suspect Tuley freed - pleaded guilty
of raping 12 YO girl; girl admits she lied


A man who pleaded guilty to sexually assaulting a 12-year-old girl was released from prison Friday, freed by an appellate court ruling that supported his subsequent claims of innocence.

Ronnie Tuley, 33, was wrongly convicted of raping his former girlfriend's daughter in 1996, according to the Dec. 18 ruling by the Texas Court of Criminal Appeals.

The girl who once told Dallas police that Mr. Tuley raped her now says she invented the crime to get Mr. Tuley out of her home and away from her mother. Two of her friends also have given statements that the girl told them at the time that a rape never occurred.

When his July 1997 trial ended in a hung jury, Mr. Tuley pleaded guilty to receive 10 years' probation. He said he couldn't afford another attorney and feared that a previous marijuana possession charge meant he could have been sentenced to up to life in prison if found guilty of the rape.

Mr. Tuley's probation was revoked in October 1999 after he failed a drug test. He began serving the 10-year prison sentence.

Mr. Tuley's lawyers said the young woman decided to tell the truth after a friend wrote to her and told her Mr. Tuley had gone to prison. The young woman then wrote several letters and affidavits saying she lied about the rape.

Prosecutors have argued that Mr. Tuley should have pursued clemency rather than an appeal. They say they worry that the appeals court ruling will lead frivolous appeals by defendants who have pleaded guilty. They also said that such a ruling could lead some defendants to pressure rape victims to recant.
