Judge sets curfew for suspect in waitress killing

A judge on Tuesday imposed a 5 p.m. daily curfew for a 19-year-old murder suspect who was able to post a bail bond this weekend in the death of an Irving waitress.
Sarah Foust must remain at her mother's Grand Prairie home from 5 p.m. until 6 a.m., state District Judge Janice Warder ruled. Ms. Foust also is not allowed to drive or drink alcohol, and she must show up at every court setting.
"They're reasonable conditions, and she will abide by them," said David Scoggins, one of Ms. Foust's attorneys.
He said that Ms. Foust's family, friends and members of a Protestant church he would not name had raised about $10,000 and written out various promissory notes to post her bail bond. He said many of them used rapid tax refunds to raise funds.

Judge Warder turned down prosecutor Keith Robinson's request to place Ms. Foust on electronic monitoring. The judge imposed the bond conditions at the end of an evidentiary hearing in which she ordered that the case be sent to a grand jury.
Irving police Detective Randall Johnson testified that Ms. Foust; Kortnie Henson, 19; David Thornton, 19; and Michael John Prewitt, 26; were served nine drinks that night. The receipt listed one Heineken, three strawberry daiquiris and five "liquid marijuanas" on the tab, he said.
"Liquid marijuana?" Judge Warder asked, stopping the testimony.
Detective Johnson said the drink was a concoction that included rum and coconut juice.

Dawna Kim, another attorney for Ms. Foust, asked a series of questions designed to elicit why detectives had charged the 19-year-old with murder rather than the lesser charge of intoxication manslaughter.
Detective Johnson said several eyewitnesses told police that Ms. Sanchez had nowhere to go to get out of the way of the car - except on the vehicle's trunk and roof. He also said that witnesses reported seeing Ms. Sanchez screaming and banging on the top of the car.
After the hearing, Mr. Scoggins said his client had never had a driver's license nor taken driver's education.
Asked why Ms. Foust was behind the wheel that night, Mr. Scoggins said: "We know that answer, but it's not fair to answer that right now."
Mr. Scoggins noted that he and Ms. Foust had given Detective Johnson more information about possible whereabouts of Mr. Prewitt, who is wanted on misdemeanor warrants that accuse him of theft of service and providing alcohol to minors. Mr. Prewitt was not in the car, but police said they believe that the front passenger seat was open for him.

She's 19?! Prison may be a big improvement for that girl. She can finish a high school degree, maybe get some further college or tech education - and best of all, she can't breed anymore for a long time.

I think it's a crying shame, and I wouldn't a raised a lead nickel to get Foust's sorry a$$ out of the hoosgow.
