Carl Cameron on now. It comes down to the law (yes Carl, we already know that). Torricelli 's one option is to resign, allowing McGreevey to appoint a replacement who could be put on the ballot, or allow someone else to be put on the ballot. By what legal mechanism can they put anyone new on the ballot though? The deadline has passed. I'll bet that's what they are scurrying around to figure out. If they can't find something that flies, cancel the press conference?

Now it's going to go down to the timing of his resignation. If today or prior to October 6, then no problem. If between October 6 and November 5, then problem writ large. If after November 5, then no problem.Which means it comes down to how much the Torch thinks he's been screwed over himself by the Democratic Party. Wouldn't it be interesting if the reason this backroom dealing is all taking so long is because McGreevey and the Carville RAT brigade are trying desperately to find some job or position with which to appease the Torch, who's so pissed off at the RATS himself that he absolutely refuses to quit before the 6th?

If the Torch resigns now, McGreevey appoints a replacement who, by virtue of his "incumbancy" is then automatically on the ballot. Pubs are ready to challenge this in court tomorrow apparently.

You know, they have nationalized the Senate elections with this maneuver. There is nothing to stop the RNC from running ads n every Senate race calling attention to this tactic and asking for Americans to discredit this type of disenfranchisement.

They're now saying that if someone steps down within 51 days of an election, his/her Party may NOT appoint a replacement. That's NJ law; reported on FNC just now by Shepard Smith.
