The governor of this state may make a temporary appointment of a senator of the United States from this state whenever a vacancy shall occur by reason of any cause other than the expiration of the term; and such appointee shall serve as such senator until a special election or general election shall have been held pursuant to law and the board of state canvassers can deliver to his successor a certificate of election.

Since I don't think that this has been tested, and the Senate does have final say as to who sits there (Article I, Section 5, US Constitution), so long as the RATs get and maintain a majority, they'll try.

The issue is whether votes for Toricelli could be claimed for a new appointee from the Dem Gov.

That wouldn't seem right. What if , say, 20% of the voters wouldn't have voted for that person? If it were legal, heck, that would be an election loophole, and ever state could try it. Run one person, ask him to leave, and the Gov. chooses the next Senator. Doesn't sound good. One party would always win depending on who the Gov, is.

Now it's going to go down to the timing of his resignation. If today or prior to October 6, then no problem. If between October 6 and November 5, then problem writ large. If after November 5, then no problem.
