According to NJ election law the 'Rat party would also have to approve another name on the ballot besides the Governor (if it happened before the deadline)

The ballots may already be printed. The deadline for putting someone else on the ballot has passed. The issue is whether votes for Toricelli could be claimed for a new appointee from the Dem Gov.

Republicans are expected to challenge in court if state officials allow Toricelli to be replaced by another candidate because only 36 days remain before the election. State election law mandates 48 days must remain for a party to replace a candidate.

Let's get our Jersey lawyers moving. The delay must be a signal that the dem lawyers are plotting their strategy. I hope we learned from Florida that they will stop at nothing.

I don't think this matters. The deadline for putting a different name on the ballot has passed. SO, they're going to try to say that votes for Torricelli will really be votes for whomever the Dem gov decides to appoint.

Regardless, McGreedy would still have to appoint someone who's qualified to serve under NJ state law. (He couldn't appoint a resident of North Dakota, for example.) Which totally rules out the horrifying concepting of Sen. Bill Clinton.

From another article which seems to indicate that Jersey law can allow for the election to be cancelled if the resignation comes within 30 days of Nov. 5 and rescheduled. So there is a time frame of 6 days for all this to happen since a replacement is beyond naming now that it's below 48 days....


Under New Jersey law, a political party can replace a statewide nominee on the ballot if the person drops out at least 48 days before the election. But only 36 days remain until the Nov. 5 election, meaning Democrats would have to seek approval from the state attorney general. That would likely result in a court challenge from Republicans.

Under state law, if a candidate resigns his office or dies with more than 30 days to the election, the governor can appoint a new candidate. If it happens with less than 30 days before the election, the race can be canceled and the governor can set a new date for a special election.

Rudy's aborted Senate race, wasn't that? So federal election law is presumably what prevented Rudy from transferring the funds, not NY State law.

How can they do that? It seems as though elections are for people to choose the canidates. Since when are they chosen for everyone? Something is wrong with that idea.

They did it with Carnahan, they're going to do it with Patsy Mink. We've got to fight it, that's all.
