I'm amazed that the 'Rats already had people with talking points up on FOX...that means they have been planning this for some time and may have lawyers already in place?

So federal election law is presumably what prevented Rudy from transferring the funds, not NY State law.

That is my interpretation however I do not know about pac money ect. This would be in relations to individual contributions....

What complicates things is this courtesy Wphile:
NJ State Law.19:3-26. Vacancies in United States senate; election to fill; temporary appointment by governor If a vacancy shall happen in the representation of this state in the United States senate, it shall be filled at the general election next succeeding the happening thereof, unless such vacancy shall happen within thirty days next preceding such election, in which case it shall be filled by election at the second succeeding general election, unless the governor of this state shall deem it advisable to call a special election therefor, which he is authorized hereby to do. The governor of this state may make a temporary appointment of a senator of the United States from this state whenever a vacancy shall occur by reason of any cause other than the expiration of the term; and such appointee shall serve as such senator until a special election or general election shall have been held pursuant to law and the board of state canvassers can deliver to his successor a certificate of election.
Since I don't think that this has been tested, and the Senate does have final say as to who sits there (Article I, Section 5, US Constitution), so long as the RATs get and maintain a majority, they'll try.

The issue is whether votes for Toricelli could be claimed for a new appointee from the Dem Gov.

That wouldn't seem right. What if , say, 20% of the voters wouldn't have voted for that person? If it were legal, heck, that would be an election loophole, and ever state could try it. Run one person, ask him to leave, and the Gov. chooses the next Senator. Doesn't sound good. One party would always win depending on who the Gov, is.

There will be an appointee, and he will be popular in NJ, or they wouldn't be bothering. So we know we have that to deal with.

Now, will the people who didn't like Toricelli's ethics, go for this BAIT AND SWITCH? I don't think so.

Which is the problem with it. It makes all election "rules" not rules. If they become anything goes, then how do we have any credibility?

Now it's going to go down to the timing of his resignation. If today or prior to October 6, then no problem. If between October 6 and November 5, then problem writ large. If after November 5, then no problem.
