L.A. shooter exploited 'loophole'

The man who killed two persons at Los Angeles International Airport on July 4 gained legal residence in the United States through a limited amnesty program that has since expired but that President Bush and Democrats in Congress want to reopen.

Exactly what freedoms does this story suggest ending? I hardly consider background checks on foreign nationals -- something the State Department routinely fails to do -- as an assault on any American's freedom.

As far as making more laws, the gist of the complaints against 245(i) is that it should not be reinstated, since it provides a loophole. We need less laws that allow potential terrorists to enter the country.

Camarota, director of research for the Center for Immigration Studies, said the problem with 245(i) is twofold: Not only are the background checks more thorough in home countries, because they are done by embassies and consulates with local connections, but 245(i) applicants who are turned down in the United States can ignore the decision and the INS usually won't find them. Hadayet reportedly had failed in an application for asylum before applying under section 245(i). "Just like other terrorists in the past, he has exploited a host of loopholes," Mr. Camarota said.

Weren't we told that Section 245(i) only applied to foreign nationals who were the victims of INS paperwork snafus, and that it couldn't be exploited by terrorists?

More than a million Illegals have benefitted from various incarnations of Clinton's Section 245(i) Amnesty. Every one of them, including Hashem Hadayet, displaced a legal immigration applicant who was playing by the rules and waiting their turn in line.

Interesting, this explains why information about the terrorist identity and why the INS would not immediately disclose how he was able to avoid deportation. It's apparent they wanted this story to cool off some before they had to disclose he was granted 245i. Wouldn't want to sour the public on the rewards of 245i.

No, this story has a different twist. The loophole was in the amnesty legislation which has expired, but which GW wants to pass again. The article is more a warning about allowing 245i to be slipped back into law.
