Judicial Terrorism

The two-to-one ruling in the 9th Circuit Court of Appeals that the Pledge of Allegiance is unconstitutional, because of the words "under God," has caused a firestorm of reaction. Politicians of both parties are outraged. The Senate interrupted debate on the defense bill to pass a resolution condemning the ruling by 99-to-0. Members of the House recited the pledge on the Capitol steps yesterday and there is talk of amending the Constitution if the "Supremes" don't overturn the decision.

The reaction, of course, is justified - the court's ruling is an act of judicial terrorism. Al Qaeda strikes at the symbols of American capitalism (World Trade Center) and military might (Pentagon), while unelected judges with life tenure "blow up" our national symbols of a republic built on liberty granted to us by the "God of our Fathers."

Radical Islamists must be rejoicing today. They tell Muslims all over the world that we are the "great Satan," a purveyor of nothing but pornography, abortion, homosexuality and decadence. Now they have fresh evidence of our rejection of God to cite throughout the Third World.

Why Is There Surprise?

Having said all that, I must admit that the unanimous shock at the ruling is puzzling. Left-wing activists put on the federal courts by liberal Democrat presidents and clueless Republican presidents have been remaking America for decades and our side has been unable or unwilling to sustain a counterattack to reverse this trend.

In 1963, while I was still in high school, the Supreme Court threw out school prayer. People were furious. Billboards went up demanding the impeachment of Chief Justice Earl Warren; politicians ran and won on pledges to overturn the ruling. Twenty years later, I sat in the Reagan White House and helped draft a constitutional amendment to reverse that decades-old decision. We failed. The outrage had faded. People had accommodated themselves to the new America.

And so it has gone, year after year. Babies no longer protected by the Constitution, a right to burn the flag, and coming soon to your community, men marrying men - all in the name of a "constitution" that our founders would no longer recognize.

How Does It Happen?

This is why most of you feel so bad about where our country is headed, even when we "win" elections. You know instinctively that the only thing that changes is the speed at which the things we hold most dear are destroyed.

The liberal elites are the core of the problem, of course. They disdain the values of Main Street America. What a joke to hear Daschle condemning this decision! He and his party are blocking judicial appointments who would reject this kind of war against our values. But it is too easy to just blame the Clintons, Daschles and Kennedys of the world.

Many of our own leaders have been petrified of engaging in the cultural war directly. When Pat Buchanan spoke frankly about the cultural war at the 1992 Republican convention, the GOP establishment accused him of losing the election for George Bush by bringing up the issue. When Alan Keyes and I emphasized the attack on our values during the last campaign, few Christian leaders joined us or promoted us because they didn't want to risk losing their "seat at the table". Many applauded, but said, "No one can win running on those issues."

My friends, let me say it again: We can win the war against terror and turn our economy around, but if we continue to passively accept the redefining of America, this great experiment will be doomed.

The hour is already late. A new poll of college students by Frank Luntz came up with this startling finding: Only 3% "strongly agreed that Western culture is superior to the culture of the Arab world." Forty- three percent disagreed!

Our Western civilization is built on the basic idea that each individual has a God-given right to liberty, that free people have a right to choose their leaders and that there is an inherent worth and dignity possessed by all of God's children. The Arab/Muslim culture forces women to hide their faces, allows virtually no freedom of dissent, kills people who convert to any religion other than Islam and persecutes Jews and Christians. Yet, after years of liberal blather in our public schools, our children in the best colleges and universities in the country can no longer bring themselves to admit that the civilization that nurtured them is superior to thuggery.

In Conclusion

I apologize for the length of these musings, but this is important. I am not a defeatist. This cultural war isn't over. The "shining city on a hill" can still spread its light to a world that desperately needs it. But it will require a rededication and resolve on our part to "fight the good fight." We must insist that those we vote into office spend serious political capital to win this war for the values we love and the values we honor. That's why I have been in this fight for 35 years and why I promise to continue to fight as long as God gives me breath.

Does Bauer support the tactics being employed by his man (McCain) to block the appointment Bush's judicial nominees?

If he doesn't support what the prima-donna' from Arizona is doing, why won't he speak up and condemn him publicly?

I'm pretty tired of this pompous-pious-pipsqueak.
