Tempe voters Tuesday narrowly approved the state's toughest public smoking ban, which requires even bars to become smoke-free.
"It's a win for the state of Arizona," said Tempe retired doctor Leland Fairbanks, who pledged Tempe will be the first step toward a statewide ban. Next target: Phoenix, he said.

Misinforming the people. Jerry hit the nail on the head. These are the key words here. When our side doesn't get to voice opinions and objections, this is what happenes.
I'm sure Tempe has plenty of restaurants where the "families" can go to eat. Why not leave the business's alone to decide if they want smoke free or not. Why make it a Law or Ban?

I don't smoke but it should be left up to business oweners. This is going to hurt them more than the smokers.
Maybe we ought to pass a law that says environmentalists should give up all forms of transportation except bicycles. That will do them some good, especially when it is 110 degrees on a humid monsoon, day.
A "no-smoking" section of a restaurant/bar is like a "no-peeing" section of a public pool.

No, it was banned in PRIVATE BUSINESSES.
If you can show me a study, that has not been discredited, that says ETS is a health risk, in and of itself, with no other health factors coming into play, I might be more willing to listen.
We just had the city law here struck down recently by the appeals court. The city smoking law cannot be more stringent than the state law, as I understand it.

LANSING, MICHIGAN -- Local governments in Michigan do not have the authority to prohibit smoking in restaurants, a state appeals panel ruled Wednesday.
The three-judge panel of the Michigan Court of Appeals sided with a local judge who struck down a restaurant smoking ban in Marquette two years ago.
In the majority opinion, two judges said Michigan law bars local officials from exceeding smoking limits in the state public health code, which directs restaurants to have separate seating areas for smokers and non-smokers.
Judge Joel Hoekstra agreed that Marquette went too far, but disagreed with some of the majority's reasoning. He argued that the state health code pre-empts local standards only when they are weaker than what the state requires. But he said Marquette had run afoul of a broader state law that limits local government regulation of food service establishments and vending machines.
There was no immediate word from Marquette officials on whether they would appeal to the state Supreme Court.
The Michigan Restaurant Association had joined six local establishments and the Michigan Chamber of Commerce in challenging the Marquette ordinance.

I think the bars may have a case if they want to appeal to a higher authority. The law won't last long, IMHO.

Thanks for posting this. And this is the way it SHOULD be. Left up to the owner of a business. HE is the one who sunk his blood, sweat, tears and money into it.
NOT the Boards of Health. They pass these bans, and you never SEE them again.
