It shouldn't be "too costly" to go from a low-income period to a no-income period? As an accountant, I'm sure you know that many restaurants work on quite a small margin, and just closing the doors isn't an option.

You apparently are not following. Lets say I was a restuarant owner in the town that this happened to. A market has just been created. Smokers no longer have a restaurant they can go to. I can serve that market with almost no competition if I can lower my sales by 10% for three months and still pay my bills.

I review my sales reports and find that on the lowest sales day which in this case is Monday I find that even though I reduce my sales by over 10% if I close for the restuarant for breakfast and lunch and just serve dinner, my net income goes down by less than 5% because I have less payroll and no utility costs.

I then do this for three months and go qualify for my two year exemption. When I do this I am the only restaurant in town where a smoker can have a meal and smoke afterwards. I reopen on mondays ad my sales are up 25% or more over my best figures and my bottom line is way up.

For a relatively small cost I have created a two year niche for myself.

So, just where would smokers eat if all the restaurants are no-smoking allowed?

At home I hope.

You wouldn't be hoping that if you were a restaurant owner.

I am an accountant and I assume the city never defined sales very strictly. I could probably find a way to show a 10% decrease in a three month period for any restaurant. <

And why would they do that? No one has been able to explain to me WHY a business owner would LIE about his business being down if, in fact, it is UP. WHY would a proprietor fight for the right to go back to making LESS than he is now?

I also heard there are U-Haul It’s taking people out of California every day now. So, that doesn’t sound like CA or VT are doing too well, to me.

U-Haul is getting lots of money from people leaving California. It doesn't have much to do with the smoking bans. There are much better reasons to leave CA. Frankly, smoking bans at work and restaurants increased my options. My parents smoked until I was 13. My lungs have always been a disaster. The damage done by the smoke was later compounded by Valley Fever and seven cases of pneumonia with fevers around 103 that lasted 3 weeks. My lungs are so bad today that I have to make an immediate exit if someone lights up. I can't afford to have what little is left destroyed.

McDonalds is nonsmoking. Their choice. People like me complained that we didn't want to bring our kids into a smoke filled restaurant. They heard the market and reacted on their own.

And that's fine, as long as it is the establishments choice.

It depends on whether I was making a living or not. Seeing that I absolutely hate cigarette smoke I'd try to be fully nonsmoking.

Your experience is no less valid than the person with the opposite experience.

Gabz, you know I normally agree with the "anecdotal experience" validity statement, but this time it's just too danged familiar to be believed. (I wouldn't, however, have pointed it out had I read your statement first. Prob'ly. LOL)

You've got that right.

In fact, the problems with sick passengers were far less when smoking was permitted than it is now.

Gee - I wonder if it has something to do with the fact that the airlines no longer have to change the fresh air in the cabin as often as they used to do?????

And that would be fine, as long as it was YOU making the decision.

Turn it around, suppose you have a completely NONSMOKING restaurant and the govt came along and said that you have to allow smoking everywhere in your establishment. Would you consider that fair?

Restaurants are private property. If we were still living under the U.S. Constitution, owners of private property would be able to choose who shall and shall not be allowed on their private property.

BINGO! This is the real crux of the issue. Aside from the fact that, last time I checked, cigarettes were a legal substance.

There are many, including myself..that suspect asthma is on the ''increase'' because of better detection methods...AND a asthma diagnosis is easily paid for....and thus "if it wheezes" it's gotta be asthma. I've alot of anecdotal evidence...and theories..but that's my take..and I'm sticking to it....hehehehe......

I have one friend with a small restuarant here in NYC, he actually removed two tables instead of having to ban smoking.

If Joe Cherner's bunch in NYC have their way, the exemption your friend depends on will be done away with. Make sure he/she knows about the NYC C.L.A.S.H. website to keep abreast of the encroachments on liberty planned by the antis.

It was the smoking ban and not a near recession? BS all the way, we've had no smoking for years in CA and we do great.

No, "we" don't "do great." We have 1036 fewer dine-in restaurants than we should have according to the amount of growth here since the bans took effect. Even Palm Springs is having to permit drive-thrus on historic Palm Canyon Drive, and the hospitality business in SF is down to 1994 levels. If you intend to spout off in favor of the loss of liberties, you really should get the facts first.

I've not read all the replies...so forgive me if someone else has pointed this out. Being that most here are FReepers..I'd bet someone has already has.

But my point, or observation is this....Why O why in heavens name can't the OWNERS of the bars, eateries, bowling allys...etc..etc. be allowed to declare THEIR PROPERTY..."Smoking Allowed" or "Smoking Banned"....PERIOD..!!

Oh...that would be giving people some control over their freedoms...and we can't have that..!!!

P.S. I'm a non-smoker..but a passionate freedom lover....!!!!!!!

One of these days they will all finally learn - 25% of the adult population in the US smokes - if they refuse to serve us they will loose 25% and more of our $$$$. All of us smokers have friends and family who don't smoke, but don't care that we do and WILL patronize the places that are accomodating to evryone.

and no utility costs.

What do you do, have the phone, electricity and gas disconnected during the breakfast and lunch times on Mondays?
