The judge wrote that the Trump administration’s defense of her firing “flies in the face of nearly two centuries of Supreme Court precedent.”
A federal judge in New York ruled Monday that the Justice Department unlawfully fired Maurene Comey, daughter of former FBI director James B. Comey, from her job as a federal prosecutor.
Comey had argued in her federal lawsuit that she was fired because of her father, whom President Donald Trump fired as head of the FBI during his first term, and because of her perceived political beliefs. The Trump administration has brought federal charges against her father, who became a prominent critic of the president after he was fired.
The Justice Department countered that Comey, as a federal prosecutor in New York, was an executive branch employee whom the president has the broad authority to terminate.
But on Monday, U.S. District Judge Jesse M. Furman in the Southern District of New York ruled that the Justice Department was wrong and wrote that the government’s defense of her firing “flies in the face of nearly two centuries of Supreme Court precedent.”
“Indeed, to accept Defendants’ argument would be to unsettle the very equilibrium established by this Nation’s constitutional system,” Furman, who was appointed by President Barack Obama, wrote in his 55-page opinion.
Comey is one of the scores of career employees whom the Justice Department has fired during Trump’s second term, often with no explanation beyond citing the president’s powers under the Constitution. She had worked as a federal prosecutor handling high-profile cases, including those brought against sex offender Jeffrey Epstein and Sean “Diddy” Combs, the music mogul.
Career government employees are generally afforded broad protections to ensure that they are not fired for political reasons and that their...

Each United States attorney is subject to removal by the President.
This will be overturned.
Both Clinton and Obama fired United States attorneys without any legal objections raised.
A system where Democrats are allowed to do things which Republicans are not allowed to do is not a system of "laws". It is not a tolerable system.
Holy crap... now they’re reversing employment decisions. These POS judicial scum need to be eradicated from the bench...

Looks like the US has the same problems as Brazil does regarding judges.
And she better not be given her job back in the meantime either.
That would allow her the option to quit, get what ever benefits she’s built up and be eligible to reapply for government service in the future.
None of that is good for America.
She wasn’t a US attorney. An AUSA is a career employee, not an appointed one. That does not apply here.
Lol 200 years of Supreme Court decisions say the president can’t fire someone at the Justice Department. Yeah sure.
What if the employee is not a broad?
When people around us complain that President Trump hasn’t done anything and ‘where are the arrests’ they refuse to realize that the justice department still being a thug shop is a problem
They need grow up, they need to vote Republican in the midterm and they need to grow the heck up
Look at this.

I just looked it up. The head federal DA is a political position. But the assistant positions are evidently civil service.
Nevertheless, she’s got to go. Trump’s team just needs to figure out a good way to get it done.
Every judge in the US knows we don’t need no steenkin’ laws to tell us what to do.
This is why you don’t hire relatives.
“U.S. District Judge Jesse M. Furman wrote that the government’s defense of her firing “flies in the face of nearly two centuries of Supreme Court precedent.”
Hopefully. But even assuming that it is, it'll take, what -- a week? A few weeks? A month? Every week or month or couple of months spent on appeal(s) is a week, couple of weeks, month, etc. that can't be gotten back. Starting to feel just a little uneasy about the future.
Who knows? Maybe Trump will find a way around the 22nd Amendment. Repeal of a Constitutional amendment has been done before, so I guess it would be THEORETICALLY possible (emphasis mine). On the other hand, he's 80 . . . .
28 U.S.C. § 541(c)
Each United States attorney is subject to removal by the President.
Exactly. Another political advocate, not a real judge. He should be dismissed next. People just can’t seem to read the Constitution and laws when they are ‘liberals’ anymore.
This lawfare is getting ridiculous
Jesse M. Furman is a obummer appointee.
Jesse Furman is FULL OF CRAP !
