Alito says Supreme Court can’t stem emergency appeals and voices concern over Trump’s rhetoric

On Tuesday, Supreme Court Justice Samuel Alito released a book noting that emergency appeals have skyrocketed during President Donald Trump's second administration, now rivaling cases the Supreme Court considers with full briefing and oral arguments.

Presidents increasingly enact policies through executive orders rather than Congress, fueling lawsuits and robust lower-court rulings that force rapid Supreme Court intervention, Alito explained.

Alito rejected claims his rulings align with the "Make America Great Again" camp, stating "I honestly try to decide every single case on the merits, every single application on the merit."

Trump has praised Alito as "one of the Greatest of All Time" while simultaneously maligning other justices he appointed as "unpatriotic," reflecting broader political pressure on the Court.

The Court remains at the center of debated issues including the president's ballroom construction and mail ballot restrictions, with Alito warning the surge in emergency decisions is "going to continue.

Alito says Supreme Court can’t stem emergency appeals and voices concern over Trump’s rhetoric

WASHINGTON (AP) — Supreme Court Justice Samuel Alito says the escalating volume of emergency appeals before the court isn’t a good thing, but he adds there’s little the court can do to change the trajectory.

The number of petitions asking the justices to intervene quickly has skyrocketed during President Donald Trump’s second administration, putting the court at the center of hotly debated issues such as the Republican president’s new ballroom construction and his proposed restrictions on mail ballots in the midterm elections.

The number of emergency applications now rivals the annual tally of cases the justices consider with full briefing and oral arguments, Alito wrote in a new book released Tuesday.

I agree the Supreme Court is over encumbered this way. But shouldn’t Alito direct his ire and venom at the democrats and DNC funded NGOs filing these frivolous lawsuits to attack the constitution?

Actually he should direct it at the lower court judges that keep ignoring what the scotus rules and tries to override the SCOTUS. One judge has been appealed 3 times to the scotus on the same case/issue.

Its either that, or very contentious issues and government change resolved through civil war

Take your pick, Justice Alito

Actually they all should. Plus Skywise said what Alito should do since the article is about Alito’s book and what Alito is complaining about.

But I guess, by your point you think alito should be complaining to Roberts about Roberts lack of leadership and not holding lower judges accountable. Which I would concur with.

Roberts about Roberts lack of leadership and not holding lower judges accountable.

Roberts would say that's Congress' job (which it ultimately is). Hence, I think we need a statute that dictates an automatic suspension of a Federal judge having suffered a specified number of reversals as indication of failure to uphold "good bahavior" as specified in the Constitution. The suspension would trigger a review by the Senate.

frankly Alito is right; there is little or no justice left in the American courts, because the whole system that produces lawyers in this country is largely corrupt.

that Big Law cartel with it’s large and powerful law firms and corrupt bar associations have captured the uniparty Congress and State legislatures, which have abdicated their collective constitutional power to approve the fair and remove the corrupt. thus the black robed tyrants now rule America with impunity through lawfare.

until Big law is defanged, and the Legislatures start doing their jobs again, nothing permanent can be done, unless Trump decides start defying the black robed tyrants with the constitutional power of the executive, ala Lincoln, Jackson and Jefferson.

I just did some research and it looks like the system is rigged to allow judges to do what they want.

All misconduct cases are handled at the circuit judicial council. SCOTUS doesn’t do anything with that. And even if you have a complaint against the chief justice of that circuit...the complaint stays in that circuit, just the #2 judge looks it as an acting chair. So in other words the complaint goes nowhere!

The courts don’t even report to the SCOTUS! This is insane!

In some instances it seems to be high crimes. (like the Fed judge in FL declaring illegals couldn’t be denied voting rights in Fed court even when voting for fed officers) The issue is it still then a matter of being convicted by 2/3 of the Senate? I know they are not SCOTUS, but I’d bet money the Leftist brigade would insist upon it.

State of siege needed. Trump should go full Pinochet.

Full NOPE on that. If the polity is so corrupted that the polity no longer cares about law and only seeks to empower an elite, the Pinochet response is both ineffective and divisive. OTOH, John Locke dealt with this problem, but that response is indistinguishable from civil war. There's no good answer here. I wouldn't want to live under Pinochet, though, since I'd always be looking for the political favorite demanding bribes "to fight communism" or the death squad at night.

That’s not a Constitutional provision, so Congress can’t make the Supreme Court comply with it. The only Constitutional way to remove a Supreme Court justice is by Impeachment and Senate conviction.

The parallels between the lawfare in the US and the way Hugo Chavez used the Venezuelan tour system to take tota;itarian control of the country is striking

The Democrats are using the Chavez takeover of Venezuela as a dry run for their US power grab

And you see nothing in your desire for Trump to do this that might just might put a rather large tear in the Constitution?
