Trump fails to undo E. Jean Carroll verdict at Supreme Court

The Supreme Court once again declined to take up President Trump's attempt to toss a jury's $5 million finding that he sexually abused E. Jean Carroll.

The big picture: Carroll's payday had been long delayed as the president fought the verdict. The Supreme Court already declined to throw it out earlier this year.

Driving the news: The justices did not explain their reasoning for declining to take up the challenge, as is typical.

It should be obvious by now Roberts enjoys hurting Trump. No doubt he rationalizes this hate by basking in a bipartisan glow. In the meanwhile it has turned the court from a protector of the innocent into an enforcer of the mob.

If one or more Supreme Court justices dissent from a decision not to review a case, is that public knowledge? Or was it a unanimous decision, with even Justices Alito and Thomas deciding not to review the case?

With just about anybody else at any time in world history, that case would have been thrown out with that answer.

It is an outrageous affront to common sense, not even throwing in the evidentiary aspects, which are more cautious and have a much higher bar.

What the ruling leaves in place

Important nuance

A denial of rehearing does not necessarily mean every justice agreed with every lower-court ruling or with the jury’s findings. It only means there were not enough votes to grant Trump’s request to reopen the matter. Because no justice publicly noted a dissent or statement, the Court’s order provides no reliable way to identify how any particular justice voted.

The justices think that SCCOTUS exists to set policy, not remedy errors, no matter how political or unjust. I don’t blame Trump for using insider knowledge to profit on the stock market as he is immune from prosecution as POTUS. He can pardon himself when he leaves office if he wants. No man should be subjected to such vexatious litigation from a female lunatic like this.

This is a real injustice, she sure gets different coverage and different results than what Clinton’s credible accusers got.

Gennifer Flowers even pulled out audi tapes that Bill didn’t know she had, and he still denied it and got away with it in the media, while apologizing to Mario Cuomo for remarks on the tapes.

“News reports at the time speculated that the taped phone conversations between Flowers and Clinton could have been doctored” was the media reaction.

I know reading the article is anathema around here, though I admit that the article, like most reporting on legal issues, is very sloppy and buried the lede: the issue before the court was whether his conduct was shielded by presidential immunity. I always thought this was a lame argument, not likely to succeed, and his lawyers knew it, too
