Judge Blocks DHS From Obtaining 17 Million Commercial Driver’s License Records

A federal judge on Friday temporarily blocked the Department of Homeland Security from obtaining 17 million Commercial Driver’s License records.

US District Judge Anthony Trenga, a George W. Bush appointee, entered an administrative stay and prevented the Trump Administration from obtaining the records it subpoenaed.

Judge Trenga also ordered the DHS to immediately return any subpoenaed documents and not inspect the records.

The judge said he needs more time to consider the motion to quash the subpoenas.

On Friday, 21 Democrat state attorneys general and DC filed lawsuits challenging the records request.

The blue state attorneys general sued the Department of Transportation (DOT), the DHS and the Federal Motor Carrier Safety Administration.

Last month, President Trump unveiled his “Freedom Haulers” initiative to license veteran truck drivers and crack down on illegal alien truck drivers.

“Thank you all for being here as we take action to get illegal alien truck drivers off the American roadways… and replace them with proud American veterans. And it’s about time,” President Trump said last month.

President Trump said at least 30 people have been killed by illegal alien semi-truck drivers in the past year.

“President Trump’s administration has made our roads safer by taking illegal alien, non-English-speaking truck drivers off America’s highways. Now, through the Freedom Haulers initiative, the president is expanding opportunities for our veterans by making it easier to obtain commercial driver’s licenses once they conclude their service,” White House spokesperson Anna Kelly previously told Fox News.

“By leading a multi-agency process spanning the departments of Transportation, Labor, Veterans Affairs and War, President Trump is bolstering America’s trucking industry, which is crucial to strong supply chains, while helping our nation’s heroes transition to civilian life with quality, good-paying jobs,” she said.

Win the mid terms and then give these judges the finger.

Tell them to go crying to Roberts if they don’t like what the President does with Executive Authority.

After the mid terms, which the Republicans are going to win, it’s GO TIME on nonstop deportations and every EO Tump has issued since the beginning of his 2nd term.

Without the threat of Impeachment and removal from office there’s really nothing they could do about Executive power.

In the U.S., the federal government’s authority over vehicles on (or traveling in) interstate highways mainly comes from federal regulation of “interstate commerce,” especially for commercial vehicles. Practically, that authority is exercised through DOT—most importantly the Federal Motor Carrier Safety Administration (FMCSA)—which sets national rules for motor carriers and drivers in interstate commerce (e.g., safety standards and hours-of-service, driver/vehicle requirements, and hazardous materials rules), published in the U.S. Code of Federal Regulations.

Federal law also lets DOT preempt some state rules in areas covered by those federal safety regulations (so interstate trucking hazards addressed by FMCSA rules fall under DOT/FMSCA rather than OSHA).

Meanwhile, states still operate and enforce many roadside controls (like weigh stations), but those state actions operate within the federal framework for what’s required when you’re engaged in interstate commerce.

I guess I can see a reasonable line of reasoning. In colonial times, there was a good deal of animosity towards general warrants which allowed crown officials to inspect the boats and ships of anyone they speculated was engaging in smuggling. That practice was ended.

a judge has the power to stop Department of Homeland Security... I would just go Swat this guy and not even give him a trial. Just throw him in a hole somewhere for a minimum of 6 months. then, let him out as if nothing happened. Do that to 1 or 3 more and Viola!! You wouldnt have that problem anymore...

Veterans. There was nothing to stop them from getting those jobs unless you take into account the path of least resistance, employers going cheap. This will be better but they have to know that Waymo will make those jobs obsolete in a few years.
