ICE requests Cook County sheriff to serve immigration subpoenas, threatens charges otherwise

COOK COUNTY, Ill. (WLS) -- U.S. Immigration and Customs Enforcement is threatening to have Cook County Sheriff Tom Dart criminally charged.

In letters obtained by ABC7 I-Team through the Freedom of Information Act, ICE requested Sheriff Dart serve immigration subpoenas.

The federal agency said failing to serve them could result in prosecution for tampering with a witness.

The Cook County Sheriff's Office says it cannot release an individual in custody to any law enforcement agency or federal agents for an interview.

The sheriff's office also says three of the individuals named in the letters were released before the office received them.

ABC7 reached out to the U.S. Department of Homeland Security for comment but did hear back yet.

My understanding is that a sheriff has a lot of power and independence. Does anyone know how much the feds really have control here?

IIRC the US Constitution contains what's called the "Supremacy Clause" which basically says that Federal agents can do a particular thing if it's consistent with Federal law even if it violates a particular state's laws.

Our filthy bull dyke millionaire Maoist Governor here in Massachusetts just signed legislation barring ICE agents from entering certain places (schools,court houses,etc). The local ICE office then released a statement saying something like "OK,try and stop us".

Federal officials who want immigration agents to detain and deport Cook County Jail inmates have threatened Sheriff Tom Dart with prosecution if he doesn’t give them access.

Letters hand-delivered to Dart’s office in July send a clear message that U.S. Immigration and Customs Enforcement agents want access to people being detained in the jail.

Dart denied the request and so far has not been prosecuted, but the threats are the clearest signal yet that the U.S. Department of Homeland Security wants to take people into custody in a less public way than unfolded in 2025 during Operation Midway Blitz.

During Operation Midway Blitz thousands of people were arrested, the National Guard waited in the wings and body-worn cameras became a requirement for agents, an unblinking eye that captured some but not all of the immigration crackdown — including the missteps and misbehavior of agents.

Since then, DHS got a new boss who has signaled he wants deportations to continue at the same pace, but in a less visible way.

“We are going to take a different approach that can be more effective and less public facing,” Markwayne Mullins said in June.

“I’m being told every day things are happening, people are being deported, swept up, in a much more clever way,” said retired judge Ruben Castillo, the head of the Illinois Accountability Commission. “It’s hard to nail that down. There’s not easy ways to videotape.”

Sheriff was under a FEEDERAL consent decree in 2010

The gray area. A sheriff cannot obstruct federal agents from the discharge of their duties. Conversely I know of no statute that compels local law enforcement to assist federal agents .

I completely agree that the feds in MA (and elsewhere) can enter schools and courthouses. The feds can "do a particular thing". But for the feds to tell a sheriff that the sheriff has to "do a particular thing" seems like an interesting legal question.

Yep. Force their hand. They should do the same thing with Massachusetts after they passed new legislation restricting cooperation with ICE.

And I live in the state. Withhold funds to the state as necessary. Choke them with the purse strings.

The county sheriff is considered the supreme law enforcement for cook county. A good start.
