A Washington high school wrestler and her mother have filed a federal lawsuit after Pierce County prosecutors declined to file charges against a transgender competitor accused of assaulting the student during a girls' wrestling match.
The lawsuit, filed Monday in U.S. District Court in Tacoma, seeks damages and policy changes related to transgender participation in girls' sports, reporting of sexual assault allegations, and parental notification requirements. Defendants include the Puyallup School District, the Washington Interscholastic Activities Association (WIAA), state education officials, and others, facing allegations that officials failed to respond appropriately after the reported assault.
The complaint stems from a Dec. 6, 2025, girls wrestling tournament at Rogers High School. The student alleged her opponent, who was transgender, digitally penetrated her over her wrestling suit during a match. In an interview, the student said she did not know the competitor was transgender during the match. The girl reported the incident to school officials on Dec. 8, according to the sheriff's office.
According to the Pierce County Sheriff's Office, a school resource officer at Rogers High School in South Hill was contacted by the school's administration on Jan. 30 to report allegations of sexual assault.
Investigators stated that they were unaware of why the district did not contact them for nearly two months.
The case has drawn national attention and prompted multiple investigations.
Earlier this year, the U.S. Department of Education announced a Title IX investigation into the Puyallup School District. Federal officials said they would examine whether the district violated Title IX by allowing males to compete in female sports, allowing access to girls' locker rooms, and failing to adequately respond to allegations of sexual assault.
The Pierce County Sheriff’s Office also investigated the incident and forwarded a rape allegation to prosecutors. However, Pierce County prosecutors ultimately declined to file criminal charges.
In a memorandum to investigators, a deputy prosecuting attorney wrote that the evidence was insufficient to prove a crime beyond a reasonable doubt.
The memo stated that while the alleged victim reported digital penetration, prosecutors believed they could not overcome a likely consent defense under Washington case law governing contact during athletic contests.
The prosecutor also cited witness statements from wrestling officials and participants who described contact near the groin area as not uncommon in wrestling. With digital penetration during a match reportedly called "oil-checking" in wrestling circles, the prosecutor said the alleged conduct could be viewed as a foreseeable byproduct of the sport.
The memo emphasized that the decision not to charge was unrelated to the competitor’s transgender status.

The lawsuit challenges that conclusion, arguing that the alleged conduct was not a legitimate wrestling maneuver and should not be considered part of normal competition. It also claims school officials failed to promptly investigate the allegation or report it to law enforcement.
The lawsuit further contends the student suffered physical and emotional harm and withdrew from wrestling because of safety concerns and what they describe as an inadequate response from school officials.
The complaint names the WIAA, the Washington Office of Superintendent of Public Instruction, State Superintendent Chris Reykdal, the Puyallup School District, district Title IX Coordinator Gordon Brobbey, Rogers High School Principal Jason Smith, and a wrestling coach as defendants.
The suit alleges violations of Title IX and constitutional protections, including equal protection and parental rights.
The filing also challenges Washington policies that allow transgender students to participate in school sports consistent with their gender identity, arguing that those policies deprived the student of a fair and safe athletic opportunity and prevented her mother from receiving notice that her daughter would compete against a transgender athlete.
The Puyallup School District previously said it takes allegations of sexual misconduct seriously and has conducted its own investigation into the matter. Federal and local investigations were launched after the allegations became public.
The lawsuit seeks monetary damages, changes to athletic eligibility policies, parental notification requirements, and other court-ordered remedies.

A few years ago, we didn’t have high school girls’ wrestling, and sissy boys didn’t do wrestling at all. Now we have both. The result is a catastrophe.

You are 100% right.
It happens in both male / male and female / female wrestling all the time. You have a very thin layer of polyester over your orifice/s and you are grabbing and tumbling with another person grabbing everywhere you can get a handhold, the genitals are incidental contact to this sport the inner thigh is the target hold point and key to leverage. Getting a solid hold on that while your opponent jerks and moves and struggles with their full strength well you get the idea. It happens and it’s not intentional at all.
Yes it’s called an “oil check” in both male and female wrestling.
Same thing sometimes happens with the thumb in cheerleading. The males hoist the female flyers up by their backsides and pelvic bones. You are taught to center your palm under their pelvic bones sometimes the thumb misses the front and having the full mass of a female on the thumb there is no way thin polyester fabric doesn’t get pushed inwards. Most flyers are hoisted by their feet now and not seat lifted to limit this.
Yeah it’s true male cheer spend all summer with the best looking girls in the school and get very close to them do the math.
