Justice Clarence Thomas Blasts Supreme Court For Refusing To Hear Florida’s Lawsuit Against Blue States Issuing Driver’s Licenses To Illegal Alien Truckers

Justice Clarence Thomas delivered a scathing dissent Tuesday as the Supreme Court refused to let Florida sue California and Washington over their lawless practice of handing out commercial driver’s licenses to illegal aliens who cannot read English road signs.

The Court denied Florida’s motion for leave to file a bill of complaint in the original jurisdiction case, leaving the state with “nowhere else to bring” its claims, Thomas wrote. He was joined by Justice Samuel Alito.

This decision comes after the horrific August 12, 2025, crash on the Florida Turnpike. Illegal alien Harjinder Singh, an Indian national who entered the U.S. illegally through the Mexican border, obtained CDLs from both California and Washington despite failing English proficiency tests at least ten times in Washington and once in California.

Federal Motor Carrier Safety Administration testing after the crash confirmed Singh could not correctly answer most verbal questions and identified only one out of four highway signs.

Thomas did not mince words:

“An illegal alien who cannot read English road signs cannot drive an 80,000-pound tractor-trailer.” ... Florida Attorney General James Uthmeier brought the original jurisdiction suit arguing the blue states’ sanctuary policies and refusal to check immigration status or English proficiency created a public nuisance and violated federal preemption. Iowa and 16 other states backed Florida’s effort.

The Supreme Court turned it down without comment.

Thomas blasted the abdication:

“This Court declines to even hear Florida’s claims, even though it has nowhere else to bring them.”

He reiterated that the Constitution gives the Supreme Court exclusive original jurisdiction over controversies between states — and that the Court has no business inventing discretion to dodge these cases. If states cannot bring these disputes here, they have no judicial forum at all.

Can you sue the Supremes without a biologist?

They could be impeached, convicted and removed from office, if the justices were held to the ordinary standards everyone else is for not doing a job.

As a I.S. citizen who travels the roads in medi-vans,I thank the SCOTUS, for making me paranoid to travel while attending to my medical needs, with all these non-citizen drivers being given carte blanche in their operating motor vehicles.

Can Florida outlaw any CDL from California on their roads? I don’t see any other way to address it?

Driving to Atlanta from Missouri of course saw lots of tractor-trailers on the interstate. Many had ads on the back of the trailer saying what a great system they were to work for. I kept thinking, “I wonder when I’ll see ‘All our drivers can speak and read English’ on the backs of trailers?”

Can Florida subsidize individual lawsuits between Florida residents and those states and take a portion of the proceeds? Could be profitable.

I thought SCOTUS determined that just about anything impacts interstate commerce...

Seems to be a reasonable question for the court.

Will have to go the longer route of a other Circuit...

Or FL stops every truck at the border and inspects.

I work part time at a Wisconsin truck stop and the amount of drivers who cant speak (or barely speak) English is alot more than people realize. Many turd world drivers are also very arrogant and demanding. An accident waiting to happen. Something definitely needs to be done.

It’s more than common sense. The only venue for State to State disputes is the SCOTUS. This is one of their primary reasons for existence.

This is also the second time, in my lifetime, that they have refused to hear a state on state dispute. The first was the Texas suing other states for them violating their own election laws:

This is the second such event by the SCOTUS. The question should be, if States can give illigals operating liscences without due process, where can be go for compensation of such potentially catastrophic failures?

I was wondering how this could stand.

Illegal aliens could not get drivers licenses in California until Gil Cedillo finally got enough of his countrymen in to the legislature that they were able to overturn it.

It was considered unthinkable for decades. Cedillo was called “One Bill Gil”. He thinks only of Mexico, Mexicans and When Can We Take Over Calipornia and Ruin It.

This is what precipitated the Real ID act. California’s drivers licenses are now considered worthless as a form of ID: you can use a scribbled piece of paper from the Mexican Consulate to get one!

And the rest of the States are supposed to let these Orks come barreling in driving a beat up Freightliner overloaded at 85MPH?

may of us english speaking/reading drivers were forced out of the industry because pay kept going down and the drivers you deal with were willing to take the offered pay.

that is the ONLY reason they are here. They are cheaper than a driver like me with 1 million accident free miles on his butt.

I think some states still have weight stations where truckers need to have their rigs weighed when entering the state. I remember PA had them. Give them a quick English language check at the weigh stations.

Federal law and regulations require states to ensure CDL applicants pass a driver’s test, sufficiently understand English, and demonstrate appropriate immigration status. California and Washington defied those rules

Florida could easily create another, and unavoidable, trip to SCOTUS over the Commerce Clause

Florida police can simply check the immigration and English proficiency status of non-domicile CDLs issued by California or Washington they find operating in their state.

If Momar Singh from India is found to not be a legal resident, nor unable to pass a simple English test, he, his truck, and the goods on it - should be impounded by Florida.

The industry will quickly notice, as will CA and WA leftist AGs. Another SCOTUS case will quickly arise.
