Virginia Judge Voids Redistricting Amendment, Invalidates All Votes from Tuesday's Special Election

A Virginia circuit court judge on Wednesday struck down the state's voter-approved redistricting amendment in its entirety, ruling that the measure was unconstitutional from its inception and that every vote cast in Tuesday's special election — for or against — is legally void.

Judge Jack Hurley, a Republican appointee, entered the sweeping final judgment on April 22, granting relief to the plaintiffs on all counts. He declared the proposed constitutional amendment "void ab initio" — Latin for void from the start — and permanently enjoined state officials from certifying the election results or taking any steps to implement new congressional district maps.

The decision represents a stunning reversal of fortunes for Democrats, who had championed the redistricting measure as a way to reshape Virginia's congressional map and potentially flip seats now held by Republican incumbents. The ruling throws the state's political landscape into immediate uncertainty, with the fate of the amendment now headed to the Court of Appeals.

Wednesday's ruling was not Hurley's first attempt to stop the amendment.

He issued similar rulings blocking the measure in January and again in February — and both times, the Virginia Supreme Court stepped in to allow the process to move forward while it considered the underlying legal questions. That court has yet to issue a final ruling in those earlier cases, meaning Democrats may find their fastest path to reversal runs not through the Court of Appeals, as Jones suggested, but through the Supreme Court, which is already familiar with the dispute.

The wording was misleading and fraudulent. Every district but a couple is pretty much controlled by Fairfax County - that is not representation - no communities with common interests. “Fairness” can be subject, but that clearly is not what that map is. Compare that to the so-called “gerrymandering” of the Republican-controlled states. They are compact, contiguous districts - actual communities. They were more gerrymandered before to create a Dem district or two for the appearance of “fairness”.

It’s not. The VA SC already allowed the election to go forward and thry are controlled by Richmond so not optimistic.

Andy Ogles: Democrats just STOLE the Virginia Redistricting Election with Mail-In Ballots

Take a look at these numbers:

-Early in-person: +1.6% Democrat
-Election Day in-person: +9% GOP
-Mail-in Ballots: +45% Democrat

OGLES: “Something was off... This was a coordinated, manufactured result with mail-in ballots.”

49% of the state will soon have only 9% of the state’s representation in Congress.

Democrats have RIGGED the system.

The VA Supreme Court is appointed/elected by the Democrat controlled VA General Assembly. They will vote to uphold the gerrymandering out of self interest, i.e., because they want to be reappointed by their Dem legislature.

They keep doing it because there’s rarely any accountability. The Democrats aren’t going to hold themselves accountable. They don’t even vet their own candidates. It’s up to the opposing party, the Republicans, to hold them accountable. And therein lies the problem.

1️⃣ First passage was invalid. The amendment was taken up during a special session convened in 2024 for budget purposes. The General Assembly’s own call to the Governor (under Art. IV, §6 and Art. V, §5) and its governing resolution (HJR 6001) limited the session’s scope. Expanding it to include a constitutional amendment on redistricting required a two-thirds vote that never occurred. A Tazewell County judge found this action “void, ab initio.”
2️⃣ Art. XII, §1 requires that after first passage, a proposed amendment be “referred to the General Assembly at its first regular session held after the next general election of members of the House of Delegates.” An election must intervene between first and second passage. Here, first passage occurred during an election cycle — not before an intervening one.
3️⃣ Art. XII, §1 requires the amendment be submitted to voters “not sooner than ninety days after final passage by the General Assembly.” The timeline from second passage to the April 21 vote did not satisfy this requirement. Plus ONE challenge to the proposed maps:
4️⃣ Art. II, §6 requires that “every electoral district shall be composed of contiguous and compact territory.” The proposed congressional maps violate this contiguity requirement (rather badly).
