KANSAS CITY, Mo. (KCTV) - A Peculiar family is suing Nebraska Furniture Mart after a third-party carpet installer pleaded guilty to sexually assaulting a child.
The Accurso Law Firm announced Tuesday it has filed a lawsuit in Cass County on behalf Jane Doe, 8, and members of her family. The lawsuit alleges Nebraska Furniture Mart engaged in negligent and deceptive business practices, which resulted in Jane Doe being sexually assaulted in her home.
Enrique L. Martinez, 63, of Kansas City, Kansas, pleaded guilty on January 6th, 2026 to two counts of statuary sodomy involving a child under the age of 12. Court records show he was sentenced to 25 years in prison.
The Sheriff’s Department says Martinez has been part of a crew working on carpeting in the home. Officials say he got the child by herself and committed the assault. Martinez was arrested at the scene.

The lawsuit states if NFM had performed an adequate background check on Martinez, they would have found he was using someone else’s social security number and was not allowed to lawfully work in the U.S.
The lawsuit also alleges after NFM was made aware of the allegations, the company refused to complete the carpet installation. The family also says Nebraska Furniture Mart told them they were no longer welcome to shop at the store.

The store should be liable. Maybe in the future, they’ll properly vet the people they hire to do installations.

I managed large construction and I have to say I hope this lawsuit flies. It’s not only fair but overdue.
That was my first question. Is this someone over-editing and weaving their own tales of intrigue?
Plus, why did we have to know the defendant was a Third Party Carpet Installer, when just Carpet Installer would have sufficed?
I suspect the detailed language in their agreement allows for sub-contracting work. Quite common......but I obviously don’t have the specifics.
Would NFM be liable for a subcontractor who lied to get the job....probably not. The same language allowing sub-contracting indemnifies NFM.....for just about anything other than shoddy work.
Why would anyone do business with No Further Message. Peculiar.

Too bad the guy was here illegally, but we’re what on earth is wrong with the parents for letting their 12-year-old be in proximity to the worker, long enough for him to sexually assault her? They are at least as much at fault as the employer.

Substitution of a correctly spelled but similar-looking completely incorrect word has become entirely too common, not only in Big Media but even here on FR.
I think the third party designation matters as the Furniture Mart would want to disassociate themselves from the assault.
It was not their employee who did the dirty deed. They would want to shift the blame to the independent contractor.
Trouble is.... NFM sent the installers out. They should have done a better job vetting their independent work crews.
We know. We just shouldn't have to ask or guess ... the author is lazy.
