Virginia becomes 18th state to join National Vote Interstate Compact

Virginia Governor Abigail Spanberger has signed legislation that enters the Commonwealth into an interstate compact to give its electoral votes to the presidential ticket that receives the most popular votes in all 50 states and the District of Columbia.

Virginia is now the 18th state to join the National Popular Vote Compact (HB 965/ SB 322). The legislation passed both houses of the General Assembly, mostly along party lines. Spanberger signed the bill on Monday, April 13.

Not legal, not constitutional. States can’t enter into interstate compacts with other states.

Does anyone honestly think that had the ‘National Vote Compact’ had been in effect in 2024, that California and the other blue states that signed it would give their electoral votes to Trump?

Blue-state governors would call their legislatures into emergency session and simply pass a new law voiding the compact. Or even more simply, state legislatures would exercise their Constitutional right to vote for anyone they damn well pleased.

Well, actually states may enter into certain interstate compacts.

Yes, according to the Compact Clause (Article I, Section 10, Clause 3) of the U.S. Constitution, interstate compacts generally require congressional approval, especially if they increase state political power or infringe upon federal supremacy. However, the Supreme Court has determined that only compacts impacting federal balance require consent, leaving those that don’t increase state power exempt.
