A retired US Navy SEAL has interrupted a live television interview about Donald Trump and the war in Iran to call for the release of Australia's most decorated soldier, who was arrested over alleged war crimes.

Ben Roberts-Smith, 47, will face court on Wednesday after being charged with two counts of the war crime of murder and three counts of aiding or abetting the same charge.

The maximum penalty for the charges is life imprisonment.

The Victoria Cross recipient, who spent the night in custody, is accused of murdering unarmed civilians while deployed in Afghanistan between 2009 and 2012, as well as failing to stop members of his unit from killing three others.

Roberts-Smith was taken into custody by Australian Federal Police officers at Sydney Domestic Airport after arriving on a flight from Brisbane on Tuesday morning, in front of his teenage twin daughters.

Former US Navy SEAL veteran turned entrepreneur Mike Sarraille appeared on Sunrise on Wednesday morning to discuss President Trump's threat that 'a whole civilisation will die' as his deadline to avoid the war from escalating in Iran looms.

But as co-host Nat Barr wrapped up the interview, the Texas-based Mr Sarraille was not yet finished, issuing a pointed message to Australian authorities.

'Free Ben-Roberts-Smith!' he told a stunned Barr, as co-host Matt Shirvington changed the topic by quickly moving on to the next segment.

I remember no that long ago some Crazy from New Zealand came to Australia and shot a bunch of people so the Australian Govt grabbed their pussy and disarmed Australian citizens to make everyone safe from the New Zealand Crazys.

Not to mention what they did to Vaxx Refusers even the aborigines

I wish my passport from Hutt River was still Valid, but they depended on tourism and the covid and allowed Australia to annex them.

Elon, get a jet down there to get him out of the country with his family. We would happily give him asylum in the US if he got onto American territory, like nearby American Somoa or Guam.

You have to give these guys the absolute maximum discretion, i.e. benefit of the doubt.

—They are making decisions in a split second which politicians and lawyers, the media with their pundits have weeks and months to debate, call in experts for, etc.

—They are in fear of their life and the stress, possible sleep deprivation, don’t help judgement.

—There is the “fog of war,” and situations are often somewhat confusing. What are the rules for someone suffering and dying? The man had brain matter on his shoulder and the dash of the vehicle. He wasn’t going to recover. It really needs to be an obvious lapse in moral judgement where I would go after someone in a legal sense. I might remove them from the force, damage their career, even coerce them to seek mental health for lesser offenses, but to actually go after someone and threaten prison, it needs to be egregious and usually premediated.

Anything that requires “experts” to be called, legal debate, to second guess a decision someone made in a split second, under stress, in a dynamic world with changing rules, who isn’t a legal scholar, is wrong.

The soldier gets the maximum “benefit of the doubt.”
