A Minnesota prosecutor announced an investigation Monday that may lead to charges against federal officers, including Border Patrol official Greg Bovino, for misconduct during an immigration enforcement crackdown.
Hennepin County Attorney Mary Moriarty said in a news conference that her office is already looking into 17 cases, including one where Bovino threw a smoke canister at protesters on Jan. 21. Another on Jan. 7 involved federal officers making an arrest outside a high school and deploying chemical irritants while students and staff were in the area.
“Make no mistake, we are not afraid of the legal fight, and we are committed to doing this correctly,” Moriarty said. “Operation Metro Surge caused immeasurable harm to our community.”
The Department of Homeland Security, which oversees immigration enforcement, responded in a statement Monday night that such enforcement is a federal responsibility and states cannot prosecute federal officers.
“What these States are trying to do is unlawful, and they know it,” the statement said. “Federal officials acting in the course of their duties are immune from liability under state law.”
The statement added that local officials should instead consider how their actions have endangered federal law enforcement officers.
A message to Bovino seeking his response was not immediately returned.

Supremacy clause, case dismissed with prejudice.
These are the same people who put Officer Derek Chauvin in prison for doing his job as he was trained.
Joke
There was a person training that day in Minnesota. It was like his first day, or close to that. He participated in no part of the apprehension or holding down of George Floyd. Yet, he was convicted and went to jail for being there. That’s the America in Minnesota. Expect no justice or common sense in Minnesota.
“Supremacy clause, case dismissed with prejudice.”
Exactly! Good luck with that. Go ahead and waste more MN taxpayer dollars!
They only need to bring charges against two of them. Of course, they’re going to take it too far.
Mary Moriarty is the one who should be receiving charges.
Anyone who prevents the apprehension of a criminal illegal alien is a traitor and MUST receive the ultimate punishment! No exceptions. /spit
She is pandering to what she hopes is her base after the current regime is imprisoned and a new government is formed
Lawfare.
Against the federal government. Dead South Carolinians from 1860 are jealous.
Which means there's a law. Name it.
- Second-degree unintentional murder (while committing a felony assault)
- Third-degree murder (eminently dangerous act, depraved mind)
- Second-degree manslaughter (culpable negligence creating unreasonable risk)
The core idea behind these verdicts is that Chauvin used unreasonable force and continued it long after George Floyd was no threat, in a way that created an obvious and unjustifiable risk of death.
The Hennepin County medical examiner classified Floyd’s death as a homicide, stating his heart and lungs stopped "while being restrained" by police, with the restraint listed as the primary cause and other conditions (heart disease, drugs) as contributing, not independent, causes.
Separately, in federal court, Chauvin pleaded guilty to violating Floyd’s constitutional rights:
In that plea, Chauvin admitted that:- by using unreasonable force, and
- by being deliberately indifferent to Floyd’s serious medical needs.
- He was trained that prone restraint can make breathing more difficult and that he should move a compliant arrestee to a safer position.
- He knew Floyd had become unresponsive and was in clear need of medical aid, yet he did not check for a pulse, did not begin CPR, and did not permit bystanders to help.
- His continued use of force and failure to render aid resulted in Floyd’s bodily injury and death.
Students in the area of the action have an obligation to retreat if at all possible. They didn’t retreat. That was not a Stand Your Ground issue.
One of the true outrages of the century.
His plea and statements seem to reflect he knew the fix was in for him.
Sounds like Mary wants to be Governor...or Senator.
No standing is a term I heard alot while Trump was trying to sue folks. Lets bring it back.
Yes, because Law Enforcement should just allow violent mobs to hurl bricks and bottles at them, kick them, punch them, obstruct them from discharging their sworn duty, damage their equipment, and block their passage.
Right?
So Moriarty wants to play at being Sherlock Holmes?
