US appeals court rejects Trump admin’s bid to delay tariff refund lawsuits

A US appeals court on Monday denied the Trump administration’s bid to delay lawsuits seeking tariff refunds — a ruling that could pave the way for companies to get back the cash they previously paid for the levies.

The Department of Justice filed a motion Friday requesting to delay cases seeking up to $170 million in refunds by up to four months after the Supreme Court struck down President Trump’s tariffs on Feb. 20.

But this week, a US appeals court ordered the case to be heard by the US Court of International Trade, or CIT, where the case was filed in August.

The court’s ruling “is incredibly good news for small businesses and for the refund process,” Sara Albrecht, chairman of the Liberty Justice Center, told The Post.

The government attempted what it likely viewed as clever maneuvering to slow things down, but I suspect that only compelled the court to act more quickly,” Albrecht said. “We’ll see how the CIT proceeds, but today’s development is a significant step forward.” ***

More than 2,000 tariff lawsuits have been filed so far, by both large companies like Costco, FedEx and Kohl’s and a growing number of small businesses. More than 300,000 importers have paid the tariffs.

The Supreme Court’s 6-3 decision did not address the matter of tariff refunds. The opinion by Chief Justice John Roberts made no mention of whether money would have to be refunded, while conservative Justice Brett Kavanaugh noted in his dissent that “[a]s was acknowledged at oral argument, the refund process is likely to be a ‘mess.’”

Trump said on the day of the Supreme Court ruling, “We’ll end up being in court for the next five years.”

The importers are seeking the $179 billion dollars collected under the IEEPA tariffs. The consumers, who ultimately bore between 37%-60% the economic burden from the tariffs (Goldman Sachs etc), won’t receive the promised $2000 tariff dividend checks and will not receive refunds.

Kcuf these guys.

They didn’t pay the tariffs. Consumers did.

Are they suing pro se, cuz I don’t think they are and even if they could, how would they distribute monies back to the consumers. You know, the ones who would truly have standing.....

If companies passed the cost of tariffs along to consumers by raising their prices then the consumer should be repaid. I’m a consumer!

What is the problem...the foreign exporter countries paid the tariffs right? (According to PDJT). I guess the foreign countries could file for refunds...but foreign firms/countries have no standing with the U.S. Court of International Trade?? </sarc>

My guess, just a gut call, these companies are infested with Libs at the top and see this opportunistically to both steal some money then never paid out and get a dig in at the president.

Easy enough to find unscrupulous lawyers to lie all day making these cases.

Well, there’s the problem with the whole tariff mess. Unless the American customer paid for something that has a line item for a tariff that was imposed on it, then there’s no way the customer will have any legal standing to demand a refund.

This is why the Trump administration never should have imposed the stupid tariffs the way they did in the first place.

Too bad Trump didn’t make the new tariffs retroactive to the dates of the first tariff payments. -It might not stand up in court, but he could have tried.

They may or may not have passed along the costs depending upon their accounting practices.

But go to court, and now their accounting practices will come under the microscope.

Fine by me.

Because I’ll bet many, if not most, have been cooking their books.

Read the law.

The SCOTUS majority decision is crap.

They Obamacared the law.

Deep State decides what’s constitutional.

But the companies trying to take advantage of this will regret aiding and abetting Deep State.
