Charles Foehner, NYC senior citizen who fatally shot would-be mugger, begins prison sentence for weapons possession

The Queens senior citizen who killed a would-be mugger during an early morning shooting reported to prison Wednesday to serve a four-year sentence for criminal weapons possession.

The then-65-year-old was returning to his Queens Avenue apartment around 2 a.m. after buying a pack of cigarettes when he was confronted by a menacing Cody Gonzalez.

Just as big a problem is how did they get access to his house? If there was a warrant what was the PC? The altercation was committed in the street and was a random incident, they had no business what-so-ever in his house.

If he gave consent, then he is an idiot.

Only criminals punish people who act in self defense. The cops who arrested the guy, the DA, the Judge,... all criminals.

He was actually never charged with anything he did to the attacker.
Even in NYC there is something like justified defense.
But they found a lot (~20) guns in his place.
He was a gun collector.
Apparently, in NYC that’s crime worth 5 years.

Anywhere else, it would be a gun collection protected by 2nd!

I have no sympathy for anyone who gets run through the legal wringer like this in a foreign country like New York City.

The FBI Civil Rights Division should file a law suit for denial of second amendment rights. Slap a consent decree on the city and state.

Some prosecutors who are terrified of actually enforcing laws and going to court are more than happy to push police for a slam dunk no matter how corrupt, because it allows them to boast a 98% or higher conviction rate without actually having to do their primary job or appear in court and fight.

Wasn’t there recent SCOTUS rulings that banned permit requirements nation wide?

Seems like this case should be easily appealable.

The second amendment does not apply in certain states? Time to start removing THOSE WHO GIVE THE ORDERS to enforce unconstitutional state laws. “Accidents”, maybe?

Another good reason not to want to live in that cesspool...particularly considering who’s running it now. I’m not sure a senior citizen has much of a chance in prison nowadays. This is ridiculous! What sentence did his would-be attacker get?
